My wife received the following checklist letter from NVC today about my CR1 application:

The NVC has received the information you have submitted in reference to

the Affidavit of Support. Please be advised that you, as the Petitioner, do

not appear to meet the minimum income requirement according to the

current poverty guidelines to sponsor the intending immigrant(s) for this

petition. The consular officer will make a decision regarding this

requirement at the time of your interview. In order to avoid delays, you

may wish to submit an additional Affidavit of Support (Form I-864) for a

Joint Sponsor to the National Visa Center to assist in sponsoring the

intending immigrants. To view the current poverty guidelines, visit

http://www.uscis.gov/files/form/I-864P.pdf.

If you decide to use a Joint Sponsor to assist in sponsoring the intending

immigrants, please note that you the sponsor may not use Form I-864EZ

and will also need to submit Form I-864

Her income does not currently meet the minimum guidelines, but with my assets (in the UK) that takes it over the top. This was included on the i864. Does this mean my assets have been discounted, and are ineligible to be used?

Is it worth now trying to get a co-sponsor, or just to risk it and hope the consular officer will accept our evidence (which I think is enough to meet requirements) at the interview?

Will this delay getting an interview?

If we submit a new i-864 with a co-sponsor, will this cause a delay in our interview?

If anyone can help, I'd appreciate it.

The pettioner has to clear the Poverty guides, your assets in U.K. can not help. Ither she will need a Co-sponsor, or "And I advise against it" you can risk it at interview. But dont give consular a REASON to deny visa. That is a open invitation for a denial and heartache.

Gracious! Don't risk it. Get a co-sponsor

Sorry you had to find the hard way that the petitioner has to clear 125% above the poverty line.

This explains ALOT in my case. I wish I would have gotten this notice from NVC. They just approved my case and sent it to the consulate. At the interview we got 221g partly because of this. If I would have known, I could have taken care of it long before the interview. I was over the limit for 2007, but I owed the IRS 10k which put me below the poverty level.

I would agree with all of the above posts. If NVC is "suggesting" you get a co-sponsor, you would be wise to follow that. You could always risk it at the interview. However based on their letter to your wife it is likely you may not meet their requirements and be delayed at that point. Why not be as prepared as possible and save yourself grief later. Good luck.

May delay you by a week or so, depends on how fast you work on Co-sponosr and filling out new I-864, get moving, and good luck at your interview.

That was for one year, but I was being paid on contract in Thailand with 1099, so the company didn't withhold any taxes.

Your assets as the intending immigrant can count under certain circumstances and ''must be equal to at least 3 times the difference between the poverty guidelines and the sponsors household income". They must be assets that can be 'converted into cash within one year and without hardship to the owner'. If your assets did not meet these requirements I would suggest getting a Co-Sponsor ASAP. It can be anyone residing in the US with a passport/greencard/valid US birth certificate and naturalization papers etc... Make sure they fill out their own I-864 or an I-864A if they reside with your spouse :thumbs:

I do believe its 3 times the difference for spouses of USC's as stated on the I-864 on the assets page.

PER THE INSTRUCTIONS - CUT AND PASTED HERE.

In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current poverty guidelines for your household size. However,if you are a U.S. citizen and you are sponsoring your spouse or minor child, the total value of your assets must only be equal to at least three times the difference. If the intending immigrant is an alien orphan who will be adopted in theUnited States after the alien orphan acquires permanent residence, and who will, as a result, acquire citizenship undersection 320 of the Act, the total value of your assets need only equal the difference.
