He is here on a Visa Waiver. We have been together many times in the past though. I think he is going back to his country in June-pretty sure of it. That is why we want to get married and yes..we have been planning this. We want to marry before he goes back to his country for personal reasons. We both knew we were getting married. Like I said..he is just here on a visa waiver.

I realize what the form says. I'm sorry, but I am unfamiliar with the financial obligation I might have. I am assuming(once again) when we are married that his debt and his bills might become mine if he is unable to financially take care of them. Is this true? Even though I will still be receiving my S.S.D...I, myself, won't have enough money to financially take care of any debt that he has. I am hoping he will use his house here in the U.S. as an asset or sell it for that matter if he has to... in order to be approved on the I-864 form. Ughh :wacko:

Depends... This is more a family/marriage law situation than an I-864 situation. A prenup will handle a lot of this... but a pre-nup will not avoid anything covered between the sponsor and the US Government.

I know that. I meant if he was planning on marrying while here on his VWP.

I still think the OP should line up a co-sponsor.

Hi,

I am "Schmoopy" 's soon-to-be-husband. Let me try to clarify the matter. What happened is that I came into the country on the VWP intending to do some more work on the house I bought here two years ago. One night she told me that she was sick of being apart for months again and again and that she would like to marry so we can be together on a more permanent basis and build a life together. We have been planning our marriage and looking into all the options ever since. I will have to leave the country after my 90 days on the VWP will end - on June 27 - and find a new job in Belgium because I have certain financial obligations so staying here and adjusting status is not an option. My soon-to-be-wife is on SSDI and does not meet the minimum 125% poverty guideline of $18212 for a household of 2 so our only option is to get married while I am still here on the VWP and then continue on the CR-1 route with her filing the I-130, DS-230 and I-864 - using the house I have here in the United States as an asset to make up for the $18212 - $10200 (SSDI) = $8012 deficiency - after I return to Belgium.

The house will be there on the I-864 as an asset that can be turned into cash relatively quickly, and would be sold in the unlikely event that I would ever become a public charge. I am not sure what could be included in a prenup but she does not have any assets. The I-864 is a contract between sponsor and State but I am sure any lawyer would be able to draw up a contract between me and her that would make it effectively impossible for me to put her in the position she fears she might one day be put in? The contract between her and the State would be valid only until I become a US citizen anyway?

How will you use your asset on her sponsorship form to make up her shortfall?
