I am asking a question about my social security benefits after my boyfriend is approved for the CR1 visa. Will my social security benefits be affected after he receives the CR1 Visa? The process should be approved. Does anyone know the laws about this?

Your SS disabilty benefits dont enter into a CR-1 approval with USCIS, you just need to make sure you have financials of the NVC covered, 125% over poverty guide lines.

If your benefits are not short term and you are on them for life, then you will not loose them married or not. This is for SSD, not SSI.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

I was told before because I do have long term S.S.D. that my benefits will not be affected if we were married. I was just worried because on the I -864 form , I would have to be his sponser if he is unable to finacially support himself(which shouldn't be a problem). I just hope that when we are married and he gets the CR1 Visa that I will still have my benefits.

the I-864 refers to federal "means tested" benefits... SSD is not a "means tested" benefit.

Setting up a secondary contract that he will NOT rely on you financially, how can you in good conscious sign the I-864 when it says:

By signing Form I-864, you are agreeing to use your resources to support the intending immigrant(s) named in this form, if it becomes necessary.

The reason I recommend a co-sponsor is because your case is complicated enough to warrant one. You will always remain the primary sponsor; but even using his assets (which is extremely uncommon like paxyiba mentioned) you might not have enough income according to the poverty lines.

The "contract" you mention has absolutely no legal value in immigration proceedings.

I realize what the form says. I'm sorry, but I am unfamiliar with the financial obligation I might have. I am assuming(once again) when we are married that his debt and his bills might become mine if he is unable to financially take care of them. Is this true? Even though I will still be receiving my S.S.D...I, myself, won't have enough money to financially take care of any debt that he has. I am hoping he will use his house here in the U.S. as an asset or sell it for that matter if he has to... in order to be approved on the I-864 form. Ughh :wacko:
