The 90 day thing?

Timeline

We were planning on tieing the knot just 2 weeks before the 90 days of my visa is up but Andrew is a little worried it will not leave much time to get the paper work etc done in time. Any ideas if that is cutting it a bit fine, or if it is just strictly to be married before the 90 days is up?

28-4-2005 Met On-line. Love at first sight (know that can happen now).

8-8-2005 Met in person in the US. Visa Waiver.

22-10-2005 Engaged.

2-11-2005 Flew back to Sydney. Many tears!

5-11-2005 Began visa journey.

2-12-2005 Shadow (Andrew) posts petition.

7-12-2005 NOA1 dated the 5-12-2005.

..................Seems like never ending waiting.

12-4-2006 NOA2 Yee Haa!!!!!!

11-5-2006 Packet 3 Arrives

12-5-2006 Posted Reply and did Police Check

15-5-2006 Medical in Sydney

19-5-2006 Packet 4 Arrives

30-5-2006 Sceduled Interview

..................Interview went well, just waiting on Criminal History checks to post back with that envelopee and passport to get visa.

5-6-2006 Received Criminal History Check in the mail and posted off back to consulate with passport etc hoping for it's return with visa in two weeks.

14-6-2006 Passport and visa recieved in mail. Visa issued the 13th.

24-6-2006 USA here I come

26-7-2006 Received Social Security Card in less than 5 working days after applying.

9-9-2006 Married

it is just strictly to be married before the 90 days is up?

yupyup! the condition of the K1 visa is to be married within 90days ... you can file your AOS anytime after that!

One thing to think about is the fact that the non-USC will not be able to work for that entire 90 day period, and it can take 90 days for the employment authorization once you file AOS and the EAD, so they might be out of work for 6 months at that point.

If you're ok with that financially, and emotionally (I get depressed when I don't work), you should be ok.

Yes, K1 is really stricly within 90 days you guys must get married. Otherwise, you'll have future problems.

I don't know what paperwork problems you're referring to (since I don't know your situation), you can have civil wedding as an option, if you have problems with church paperworks.

I-129 F / K-1 Visa in 2005:

Jan 10 : Received NOA 1 from VSC

Jan 27 : Received approval e-mail

Feb 5 : Received NVC letter

Feb 9 : Received NOA letter

Mar 7 : Received packet for visa interview

Apr 25 : Medical exam

Apr 26 : Screened documents and interview approved

May 13 : Picked up visa

Sep 11 : Went to the US

Oct .... : Got SSN in maiden name

Nov 13 : Wedding Day!

AOS in 2005 till 2006 :

Dec 12 : Sent AOS + EAD

Dec 22 : Received NOA1 letter

Dec 28 : Got touched

Feb .... : Received SSN in married name

Feb 18 : Received Bio letter of AOS + EAD

Feb 23 : Appointment of biometrics of AOS + EAD

The rest is a waiting game :)

Feb 25 : Got touched AOS + EAD

Mar 1 : Received an e-mail stating EAD card will be sent

Mar 2 : Received an e-mail stating an approval letter is already sent

Mar 4 : Received EAD card in the mail

May 24 : AOS Interview

July 14 : Touched (said that the decision took 120 days)

July 19 : InfoPass Appointment & Passport got stamped for GC. What a surprise!

July 20 : Got a welcome letter from USCIS and that GC card would be mailed soon. What a surprise!

July 25 : Got a GC in the mailbox. Wow...what a real relief! My status is now clear:)

Deal with USCIS again in April 2008

Thanks all, well we have just bought a new/old house so no getting bored around here. Too much to do and I won't go into detail but it suits us better having me at home for now. We are having a celtic style handfasting and I think Andrew was worrying the guy doing it may not get his end of things done in time. But no worries and Thanks again. We are both natural born worriers I think.
