Hi Me again!

As far as I understand it.. they need a copy of both of our birth certificates? His is fine. Mine is well - I am adopted, my birth certificate lists my birth parents as my parents, not my parents by legal. How do I deal with this and the paper work? I live with my legal parent ( she divorced ) and have had nothing to do with the father for aprox 10 years.

If you're filing for a K-1 you only need to include the petitioners birth certificate in the original application, not the beneficiary. However the beneficiary will need to provide a copy of their long form birth certificate at the interview.

I was adopted as well! However, when the paperwork went through, the province of Ontario issued me a new birth certificate with the names of my legal parents on it (in my case only the one parent changed- my father passed and my mother remarried so he adopted me, but the point remains). I would try and obtain a new birth certificate using your legal parents names. What province to you live in? If its Ontario you can apply online and input all your parental information, and they generate a certificate.

Note US Citizen provides their birth cert if they were born in the USA, this proves that they are a US Citizen, if they were born elsewhere, then they provide other proof of US Citizenship like a compleate copy of their passport, or a copy of theire naturalization cert, or certificate of US citizen born abroad.

Foreign citizen provides birth cert at time of visa interview, and should have one when coming to USA on the K-1 visa, they will need it later when marrying, getting SSN, etc..
