I-765 Question No. 16

In filling out this form, I just want to verify if indeed my eligibility status (as asked it item # 16) is: (a)(6) or K-1 Non-Immigrant Fiancee of US Citizen since I am filing EAD together with the entire I-485 package (AOS) within 90 days of my arrival in US.

thanks.. there are foum links however that says it should be c-9.. Can anybody pls expound on why it should be C-9 and not a-9? thanks..

The instructions to the EAD application say--

7. EAD Applicants Who Have Filed for Adjustment of Status (That's you, filing along with adjustment of status)

Adjustment Applicant--( c )(9). File your EAD

application with a copy of the receipt notice or other

evidence that your Form I-485, Application for

Permanent Residence or Adjust Status, is pending.

You may file Form I-765 together with your Form

I-485.

The A-9 is for non-immigrants applying based on the visa, which you used to be. But now you've filed AOS so you are an Adjustment Applicant as mentioned in the paragraph above. Well you haven't filed yet, but since they go in together you are filing EAD based on AOS rather than only your K visa. And your AOS is based on your visa. I didn't explain that very well.

K visa (allows you to file)--->AOS (allows you to file)--->EAD

You may file Form-765 concurrently with Form I-485.
