Plan B anyone? (K1)

Patricia and I were discussing this the other day and neither of us really had an answer. I'm sure we're not the only ones that have considered this, so we'll throw it out to the collective group.

Is there a Plan B for anyone seeking a K1 visa? I assume there is some sort of appeals process and we can certainly get my Congress critters involved. But what after that? Is a K3 a valid option? At what point do you decide to live outside the US or throw in the towel completely and be miserable the rest of your life? (The idea of life without Patricia is impossible for me to even comprehend)

I posted this in the UK thread because we're interested in the opinions of others that are in a common situation as us.

Please note this is question is hypothetical and grew out of some idle chat the other evening. We're quite secure in the merits of our petition and have no doubt we'll join the May approval list when our time comes.

It was something we discussed in the lead-up to the interview, although my husband and I were doing a CR1 via DCF. My husband has family in Canada, and we both had more than sufficient points to immigrate there, so that was a possibility. We did not want to remain in the UK in the long term, so staying put was not an option for us, though it could be for some.

I have seen some on VJ apply for a K3 or CR1 after running into problems with the K1, but any issues related to the denial of the K1 will still need to be dealt with at the K3/CR1 stage. But as you should know, you two will do just fine at interview! I think everyone at some point has the same sort of worries, whether warranted or not. :)

I guess it depends on the reason. First on the list would be to challenge the rejection if possible - Congressmen, Senators, whatever. If it seems to be too long, then move on to the next steps...

If there was some sort of inadmissibility reason (and I didn't feel as though he had grossly misrepresented himself to *ME* about it) then I would move there. I've already got a couple of friends sighing over my opportunity for dual citizenship with the UK. Also, the 10 year plan does include serious consideration of moving over there for some time. I'd be pretty reluctant only because, since we decided to live here, I've gone and gotten myself into the housing market and a move soon would be a very bad financial decision! Also, as I'm only a few years out of school, I'd basically have to start over again - a new company might not regard me as any better than the next wet behind the years fresh out. At least we are lucky in that for those of us petitioning for UK-ers the plan B doesn't require us to make a huge culture/lifestyle change (relative to other countries).

If there was some question about our relationship bonafides (& somehow could not be resolved), I think we would go on with the wedding in October, and then go CR-1, with more diligence in our efforts to document our relationship. It would be heartbreaking to be apart for so many more months. If that still (somehow) doesn't work, then take the financial hit and go there.

well if it had happened (and I don't see any reason why it would have) we would have just stayed put in the UK....for us, there are advantages to living here and advantages to staying there.

of course, I see no reason why this will be something you need to worry about, however!

My guy and I have talked about this since we have a reason we could be denied. If so, if waivers fail, i may end up moving to England (after much prayer). Yes I think the K3 is a valid option (anyone correct me if I'm wrong). If I have to move there, well, will cross that bridge when we come to it. I rather stay here in the US but I couldnt live without my love. So, kinda seems like I'll find out what country I will live in come interview day!! :blink:

I just woke to see Pat off to work and decided to look in on VisaJourney to see what was going on. I almost snorted my water reading that! Actually I think we're the poster grandparents of K1's. Looking around, it seems we are the ages of most of your parents. That's why we've been in such a hurry to get this thing done. We're oldddddddddd.

And we're not worried. Like I said it was just idle talk one day on Skype. Like Nik+Heather, rkl57 and PB&JAM said a move to England certainly isn't the end of the world. I told Pat from the beginning that if I had to move i could. But trying to find a good job there at my age would be a bit more difficult. Hell I wouldn't even want to switch jobs here right in the states now.

Pat and I tell each other we wouldn't have this for just anybody.... and we're certainly glad we had the chance to make this visa journey with this group. You've been wonderful, Thank you one and all!

Me & Mike were talking about this too & we were talking about him coming here or us moving to Canada. But I believe it's even harder to move to Canada!

I wouldn't want to go through this process again, I think it would finish me off!

If I couldn't get into the U.S (and it looked like a waiver would take forever or the same reasons would exist with a K3) then Bill would move to England.

We even seriously considered this a few months ago when Bill was still failing to get a job in the states.. his job market was awful, so we thought if I could get us a place and a full-time job, then we'll do it the other way, especially since we know people that recieved UK fiance visas in a week!

Luckily, he grabbed himself a job and our visa was approved without problems. Now it's just convincing people that me leaving isn't the end of the world..

If things went differently and Damian was denied, I'd pick up and move to England in a heart beat! We're planning on moving to England in a few years once we're done with US immigration. So we probably would have gone the other way and came to America later in life. But our goal is to live in Europe in the future so we figured we'd start out in the US. Even tho Damian is still wishing we were in England, Missing home and getting bored being settled down, seeing as we were flying back and forth every 3 months for the 2 years before getting married, and it's almost been a year settled down here in the US.

But I don't think you 2 have anything to worry about, but it's a conversation unavoidable before the interview.
