Hi everyone, I just have a minor situation and I hope it does not trigger any RFE-s with the NVC. When I did my tax returns this year, I filed as "Married filing jointly." At the time, I applied for the ITIN number for my wife. As you know, the IRS only accepts passports as proof of identity for the G7 ITIN number application. At that time, my wife had the old passport with her maiden last name on it. After the marriage, she took my last name. So in a way, I was "forced" to put her maiden last name in the return, otherwise I wouldn't have been able to file. She's getting the new passport right now with the new last name. Anyway, my concern is that when I submit my AOS (I-864) to the NVC, I might get an RFE because the 2008 tax transcript shows my wife's maiden name on it. Should I be worried about this? My take on this would be that the NVC does not care, all they care about is that I have paid my taxes and the I-864 is filled out correctly, but I want to hear your opinions. Please let me know if you think this might trigger an RFE.

You should be ok, worst case you will have to explain why the 2008 return has the maiden name on it. You can call NVC and ask them if you need to include an explain when you submit the AOS package. What name are you listing on the I-864 for your wife?

For the I-864 I'm using her new last name (my last name) of course because from now on, that's her legal name.
