Timeline

My fiance has entered on the K1 on may 7th through JFK he did not ask for and EAD stamp but he has received one does this mean he can work?

and if it does do we have to wait til he gets a social security number? we are stuck we are not sure what we are supposed to be doing right now?!?

[*]met in New Zealand april 19th 2006

[*]kevin came to new york for 3 weeks dec 2006-jan2007

[*]chelsea went to england for 3 weeks may 2007

[*]kevin came to live with me in ny for 6 months july 2007

[*]chelsea went to live in england jan 2008 Nov - 2008

* CHelsea moves back to USA.

* Kevin Comes To NY for the holidays December - Jan

* waiting for the interview date So I can go to england for it!

Wedding - JULY 30th 2009 so excited!

[*]sent application to vermont service center july 15th 2008

[*]NOA1 Aug. 5th 2008

[*]NOA2 APPLICATION APPROVED 11/28/2008

* Medical 1-26-2009

* waiting for visa date

it is only valid for only 90 days and regardless if he wants to work he will need a SSN, so you should go apply

The new I-9 makes it virtually impossible for an employer to hire an alien with a "stamp" because you lack the required documents to fill it out

This temp-EAD stamp is now of little value (not that it was very valuable before). In reality, it will not allow a K-Visa entrant to work - only the EAD will.

  • Right now - go to the Social Security office and apply for the SS-card. Takes about 2 weeks to get the card (still will not allow for work).
  • Once you get married - file for AOS and EAD as soon as possible (also AP if desired).
  • The EAD takes 60-90 days - this (along with your SS-card) will allow him to work.

That's the best anyone can do.. :thumbs:
