Hello all, just a little update and some questons:

Just a lil background,

I petitioned for "Amy" a K1 visa in June 2008,She came 5 months later in Late November2008. We married a month later at the county clerk and USCIS recieved her AOS (i485, i864) on Feburary 25 , a couple of days before her I-94 expired. Around that time, she recieved her SSN. After our Marrage at the county this person changed. Our wedding reception was suppose to be May5th. Her Family are very old fashioned and asked for things to be done like in the old counrty, meaning we cant live together until our wedding reception night. So we never had sex. Then 10 days before our wedding she tells my family that we dont "understand" each other and that we should divorce. She waited until the last possible minute. I lost alot of money form wedding hall, flowers, etc. So I filed for divorce, and sent USCIS a letter Withdrawing the AOS, I also made an Infopass appointment. (i will be taking IO my wedding card Invitation, 350 were mailed out, i had to call everyone to cancel.

So today i had the interview infopass appointment. It was in a brand new building that was very clean and very nice. I waited about an hour after my intial appointment to be called up. When i finally was, a nice lady asked my why I was here, i told her that i would like to withdrawl my I485. She wasnt surprised, she said she sees these types of cases alot. I told her i sent my withdrawl letter to the Chicago Lockbox, she told me that i should send it with my divorce filing to the National Benifits Center, which i did today. She told me as soon as my I485 and I864 are withdrawn that the Beneficiary is bascially out of options and she dosent have much to do. She told me to make copies of all my docs. I was pretty satisfied, And as soon as i left i sent withdrawl request along with divorce filing to National benifts center, i do not wanna be responsilbe for this perspn for 10 years.

i forgot to ask her if she put some kind of red flag on her file through the computer. Does anyone know if she does.

Yea me too, it really hurts, 10 days before my wedding she says i "dont understand her". Im still in shock!

I am very sorry about it, but also thank you for sharing your story.

You are very strong to go through all this experience.

With more and more people in 3rd world countries going online we'll see more and more quick breakups in the future.

It can be hell on filipinas that marry in PI and end up breaking up and getting "hung out to dry" because the ex won't pay 2K for a annulment so the pinay can marry again and move on with their lives!

Only if you submitted something at Infopass will it go on record - did you give a notarized statement that you're divorcing as she left you, or that you are withdrawing I-864?

Only if you submitted something at Infopass will it go on record - did you give a notarized statement that you're divorcing as she left you, or that you are withdrawing I-864?

I did, but she said to mail to the NAtional Benifits center, which i did asap, she did tell me the as soon as the beneficiary changed her address, that USCIS automatically knows. I wish this can be all over soon. Anyone with any prior knowledge please advise.

Good for you! Glad you got some relief from this ordeal.

You should, as protection, serve your soon to be x with a certified letter detailing the withdrawal of the I-864/485, along with the divorce proceedings (if you haven't all ready) to cover all bases.

Your lawyer should be able to help you with that.

The CIS person you talked to probably keyed in you info on your file, but make sure you follow up with the info you sent to USCIS and NBC.

If you do recieve a letter for the interview (that was scheduled), you should still show up for it, just in case. Also, if your wife is not leaving with you, she should of filled out the AR-11 within 10 days of moving, if she doesn't, she is in violation of the law.

Oh - to clear up something. The I-864 sponsorship can be more than 10 years. The "10 year" mark only comes into play if 40 qtrs of work can be assigned to her. (which takes 10 years of working to do).

If she doesn't work ever, and no other qtr's can be assigned (due to marriage or the such), your still on the hook for the I-864.

Other than that, your death, her death, her becoming an USC, or her leaving the US (abandoning the LPR) would stop it. (of course she can't do the LPR now - as you withdrew the I-864 before the AOS was approved)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I was in shock. I still am. U think u know someone then bam! its over.
