Hi guys, What do you think about this....

My wife and I had an interview for removal of conditions I751 on May 4th Monday. I fell sick the whole weekend prior. Monday ( the day of the interview ) I was still very sick, High fever etc. I called USCIS first thing Monday morning and explained the situation to an rep- Michael ( I got his ref# as well )

He told me I had to write a letter to the New York office because they don't take phone calls and explain my reason for not showing and request another interview. I told him, it was today and they won't get the letter for a while. He then said it's fine as long as the letter is certified with return receipt posted marked the 4th ( day of interview ) they give a grace period.

Well on the 8th ( Friday ) I got a letter from the uscis stating that my wife and I failed to come or notify the service and that our petition was considered abandoned and denied. Now I made an info pass appointment for tomorrow in NY to speak with an officer Leznowshy and show him/her the certified receipt and return receipt and a copy of the letter stating I was sick and their rep's Michael and his id # Any pointers before I go?

"Grace period"? Never heard of that. Did you talk to the office you were going to?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Me neither.

No, On the letter I recieved it states that if we have good reason on why we missed out appointment come down Tuesday thru Thursday and speak with officer Leznowski and they will consider about opening up the case again.

I kind of knew it was going to happen like this, but at the time I was too sick to care.

Now I made an info pass appointment for tomorrow in NY to speak with an officer Leznowshy and show him/her the certified receipt and return receipt and a copy of the letter stating I was sick and their rep's Michael and his id # Any pointers before I go?

Supposed to be a very simple reschedule interview due to unpredictable reason, you're sick, plus the swine flu news were pretty hot topic last week, well... you don't want to get everyone else sick, so you asked for a re-schedule, esp. if you live in NYC. Mis-information line is really the mis-information line. Might be better if you wife went to the interview and hand the IO your letter of reschedule request, but it's already in the past, kind of pointless talking about that anyways. Now I think the infopass tomorrow should fix the situation, plus you have proof that you mailed the letter certified, I think you're covered. Good Luck!

My wife was going but the officer said, no need, if they want both of you, it means both of you, you have to reschedule. I'm telling you, you have to cover all your bases with these guys.

Yeah - that is why I would never recommend to cancel an appointment with the government - to many issues like yours...

I would of showed up on deaths door for the interview, then see how fast they would of processed me :)

As I stated, I was very ill and never missed an appointment before and notified them promptly. And don't talk about unusual interview until you passed that stage yourself. Interviews happen for many reasons totally unknown to you and I.

As I stated, I was very ill and never missed an appointment before and notified them promptly. And don't talk about unusual interview until you passed that stage yourself. Interviews happen for many reasons totally unknown to you and I.

It is well known and proven by the anecdotal evidence that few cases are pulled for interview at the Removal of Conditions stage. What causes those cases to be selected is not clearly known. I suspect some are pulled because there has been some question at some point during the process as to the legitimacy of the relationship; I suspect others are pulled purely at random.

Since the evidence is clear that interviews are not the norm, I'm confident in my assessment that it is not prudent to simply not show up. You have the further evidence in your hand that having 'notified' them that day didn't work out in your favor.

I'm sorry you were taken sick that day. I hope you get the situation sorted. But IMO you now have a problem you could have avoided even if it meant you took yourself in to their offices loaded up on antibiotics.

It's all about money with these pricks. I did what I was told by a USCIS rep and was ######. Now I have to pay $585.00 and file another piece of ###### form. All because I was sick with 103 fever, and did what I was told. Now I know why the phone reps can't give out the last names, most would be dead.

I guess they told you to file motion to reopen at infopass. Sorry to hear that. May be you get can senator/congressman involved since you were given wrong information of the USCIS rep. You still have his/her rep. id number?

Hi Peter&Alyona,

Sorry to hear about your situation. Now you and all know that no matter what never an appointment. I was bit late on my infopass appointment and the IO didn't give me stamp for I-551, his reason was I have NOA which is correct, but now if I think of it, it was also coz i was bit late due coz I got a flat on my way to the appointment. USCIS has "Might is Right" rule, so I guess we have to obey what they say no matter how wrong they might be.

Wish you Good Luck. Contact either Senator/Congressman/woman and ask for their Immigration expert to deal with it. If they can't help and then you have no choice but to cough up the reopening of your case which is what they are asking you to do.
