HELP PLEASE!!! OUR LAWYER IS DELAYING EVERYTHING

I got a RFE and the operator told me I have to fill out the 230 again because questions 2, 3 & 20 were filled out wrong. I know why #20 is wrong but I'm not sure about questions 2 and 3. Can you guys please help me?

Question #2 says: "Other Names Used or Aliases (If married woman, give maiden name)". I never changed my name after I got married should I put N/A or should I write my maiden name eve though it is the same name I use now

3. Full Name in Native Alphabet (If Roman letters not used): What do I write there if it's spelled the same way?

And last question, my husband and I really don't trust our lawyer. This could have been approved already and he has delayed the process by about 1 month already. I talked to my lawyer and he said they're not going to send anything until they receive the letter with the rfe . Since the NVC operator already told me what questions are wrong, can I just fill out the 230 again, print out another barcode and send them to them myself without waiting for the lawyer's approval? The lady at NVC told me I could print out another barcode and send it in without having to wait to receive the RFE letter

Yes, write your maiden name.

Place nothing on that line. (I take it you mean your name is in roman letters)

Either way, wait for the RFE or print out your own barcode.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

IF MARRIED WOMAN , GIVE MAIDEN NAME ,,so that means if married they ask u to put the Maiden ..and logically if not Married put your Maiden still ..a friend got tht problem and thts how it was fixed ...so put ur Maiden in tht field..

full name in Native -------------- if ur name is roman ..then put N/A,,if its NOT roman ..then wrte it as exactly its in the non roman language ..for ex ...my name is non roman (arabic one ) ,,so i wrote my name wz arabic as its inall my documents ...

as of ur last Question ..your lawyer act as ur Agent ..so they will recieve only packages from him as the agent who take and send all the required ..so i GUESS u cant ..but call NVC to check this ..may be u can

lawyers are a very wrong choice ..may be good in anothers ..

Yes, you have to wait until you get the RFE. Otherwise there is a good chance USCIS will not match up your changes to your original petition, causing you greater delay.

You are not obligated to keep your attorney if you are that unhappy with him. He is working on your behalf, after all, and that does not work if you cannot trust him. However, before you do anything, have you discussed this with him personally?

Also, before you do anything, I would be very careful and take any necessary steps, so no paperwork will go to his office after you fire him. I know that, when attorneys change in a case, sometimes the one that got replaced can be difficult about sending the case paperwork etc. This should not happen and is not professional, but unfortunately it sometimes does. And this could further delay your case.

Is there at this time a lot your attorney still has to do (except for sending the RFE info, which you could also do yourself)?

as i said ..the best about the RFE`s specially wz a lawyer involved is to cal NVC and ask to talk to a SUPERVISOR

yep, call NVC.. ask them what to do if you want to fire the lawyer.

likewise, number two write your maiden name... again. even if you've already written it above under the beneficiary's name.

in the other number write.. N/A

To add to my frustration, I just received the email I requested from my lawyer with the copy of the 230 they submitted. For question #9 where they ask how many times I've been married, including my present marriage, they left it blank. I feel like my husband has really wasted his money with this lawyer

I personally would wait for the RFE letter to come in - and send it with the corrections.

I would also recommend not to put anything in question 3. If you use roman letters for your name, there is no answer for that question.

There are some fields that do not need "none" or "n/a", and it will only cause confusion. (Sadly, they are not very clear which ones you can do it on - but in our filing, we didn't put anything - and they accepted them)

There is even a post here (today) were someone received an RFE for putting "N/A" in that very same question!

Get a refund!

You do not need to wait for the RFE to arrive I to had to send some extra info to NVC. I called yesterday to find out what it was that was needed and once NVC told me I asked if I had to wait for the RFE checklist coversheet and I was told NO you just need to reprint the original Coversheet for the DS230 and attach that to your new papers. I did that and I mailed it yesterday afternoon Express mail and it was delivered to NVC this morning at 10:45am.

We had an RFE because I made a mistake on a date (a typo). We did not wait, but printed out a new barcode cover sheet from the online payment site and my wife sent in a letter explaining the mistake, the corrected page 2 from the DS-230, and the barcode cover sheet. Her case was completed about a week after NVC received the package. I am so glad we did not spend the money for a lawyer!!!
