hey guys, i just got my 10 year greencard approved and i am in the 90 day timeframe where i can apply for citizenship. i was reading the instructions and for the life if me, can't find anything about sending in evidence to show that i am still married to my USC husband (am filling based on the 3yrs marriage to USC). so my question is do i need to send in the same evidence like i had to for Removing conditions or the evidence is not necessary.

If you are applying for naturalization based on your marriage to a U.S. citizen, send the following four items:

1. Evidence that your spouse has been a U.S. citizen for the last three years:

Birth certificate (if your spouse never lost citizenship since birth), or

Naturalization Certificate, or

Certificate of Citizenship, or

The inside of the front cover and signature page of your spouse's current U.S. passport, or

Form FS-240, "Report of Birth Abroad of a Citizen of the United States of America," and

2. Your current marriage certificate, and

3. Proof of termination of all prior marriages of your spouse - divorce decree(s), annulment(s), or death certificate(s); and

4. Documents referring to you and your spouse:

Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or

Internal Revenue Service (IRS) - certified copies of the income tax forms that you both filed for the past three years, or

An IRS tax return transcript

How does a US passport alone suffice?

For example, my wife has been a US citizen since 2002, but her last passport was issued in 2007.

It's proof of US citizenship but it's not proof of US citizenship for the last 3 years.

Anyways, a copy of her certificate of naturalization will do.

I guess, the passport has to have been issued at least three years ago.

The additional evidences/documents you need for the N-400 are not mentioned in the N-400 application and N-400 instruction. I made the mistake of not sending the required evidences because I followed exactly the requirements in the 400 application and N-400 instruction. USCIS listed the required evidences on a separate webpage link!! One would think that the required documents would be listed in the 400 application and/or N-400 instruction.

Yeah, I only found all that because I read a lot of posts and pretty much search the entire uscis site... i don't like missing anything, so i am #######, otherwise i have no idea why they try to hide the information from us!

also i think the passport only makes sense when it shows what you want it to show... if it does not show 3 years, then it may not help you since they will not do homework and check on that... they assume you will give them 100% of the answers, so on the safe side i would only give passports that are 3 or more years old.

Even though if you are basing the application on your USC spouse whom you just removed conditions with, I would assume the person is still a USC, right? but that makes our lives too easy lol... so you pretty much should give similar evidence that you already gave them several months ago for your ROC lol.
