Question on Missing NOA2

Okay, so a lot of us never received our NOA2, even though the I-129F Petitions were approved and forwarded to the Consulate.

If I understand correctly, this will be needed at the AOS stage. Correct?

Is this needed to actually get the K-1 Visa (at the interview at the Consulate)?

If so, I will probably just say screw it and pay the $340 fee to get a quick copy of it.

If not, I plan on continuing to call (USCIS, Congressman, etc) to see if I can get it free. If that fails, I'll eventually pay the fee. But the AOS stage isn't for awhile, so I could put that off for as long as possible.

Also, would be interested in hearing from anyone that was able to get another copy of the NOA2 without having to pay. I've heard in others posts some people were successful, but I think it was all secondhand information.

I am pretty sure you need your NOA2 letter for you interview. I could be wrong, check and see document checklists for the interview process.

01/13/10-Biometrics

02/04/10-Case Transferred to CSC

02/09/10-EAD approved

02/13/10-EAD received

03/05/10-I485 Approved!

I'm looking at the Instructions for Immigrant Visa Applicants in the K Instruction Packet and I don't see it in the checklist (not the copy my fiancee was sent but one I found through this site; I need to get her to scan her copy). I don't see it in the checklist. Anyone ever been required to show it?

I'm not sure why you'd need it (but the same argument would probably apply at the AOS stage where the forms definitely require it). Obviously, the Consulate know your petition was approved. If not, they wouldn't have it. But I guess that is government bureaucracy for you.

You do not need the NOA 2 for the interview at the embassy. (check with your embassy to make sure, but I have not seen it required)

However, you will need it when you file for the AOS.

Contact USCIS to see if they actually have record of sending it (if not, they have to provide one free of charge).

Sometimes you can talk them into sending you one free, but some people have had to pay.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

i might be wrong, but I think the NOA2 is required to do the medical exam and probably to gain access to the entrance at the consulate.

This time you are wrong. The invitation letter in the P4 is what you need for both of the above. NOA2 is not needed until the AOS filing.

From my experience, our NOA 2 was returned to USCIS and it shown in the website as Undeliverable.My Fiance called USCIS 3 times and we got the NOA 2 back in about 2 weeks. Please keep calling USCIS and check your address with them.
