I applied for my citizenship based on a 3 year marriage to a USC and my interview is in july unfortunately there was an argument between us, things got worse and my wife throw me out of her home and I ended in a different state as I had nobody in that state, but we are not separated or divorced. What should I do in this situation, should I show up for the interview or no, my wife says that she would accompany me at the interview but I can not no longer live in her house, but she is agreed to live with me if I rent another home. Please advise me I am so much worried, do I need to let the IO know that things happening in my life.

I don't know what the IO will ask at your interview, but since you're filing under the three-year-rule, he'll probably want to make sure, that your marriage is valid. So he might ask if you're still living with your wife, which is one of the conditions to become a USC after three years:

Spouses of U.S. Citizens

Generally, certain lawful permanent residents married to a U.S. citizen may file for naturalization after residing continuously in the United States for three years if immediately preceding the filing of the application:

the applicant has been married to and living in a valid marital union with the same U.S. citizen spouse for all three years;

the U.S. spouse has been a citizen for all three years and meets all physical presence and residence requirements; and

the applicant meets all other naturalization requirements

Also, on my oath letter the first question, I had to answer, was:

Have you married, or been widowed, separated or divorced (since you were first interviewed on your Application for Naturalization)?

I think, it would be very bad advise to tell you, not to be honest. I would go to the interview and explain. You might have to refile in two years, but at least you will become a USC then with a clear conscience, knowing you didn't do so illegally. So, what is two years compared to the rest of your life?

Our marriage is still valid, after coming down here I talked to my wife, things got better and we plan to be together once I get a place.

But are you guys gonna still live together or no? I didn't understand the concept of "u can't live in my house, but if you get a place we can live together there." whats the point of that?

This sounds very different from your first posting 45 minutes ago.

All I can say, is be honest. And have proof to convince the IO.

I have to apologize, I didn't read the part that said "but she agreed to live with me if I rent another home" in your first posting. :unsure: That sounds very odd, why can't you live in her house but she's willing to live in yours...? :unsure: But I guess, that's none of our business.

Anyways, be honest, have convincing evidence, good luck to you!!! :thumbs:

We were having problems because of an immediate family member of my wife, and that person do have a great influence on my wife, and wants her to be with me only if we move out as the home legally belongs to that person.

I saw this one on "As The World Turns or was it "All My Children"!

To meet the requirements of the 3 year rule - you must be living with her up to the day of the oath ceremony! Or else, you can wait another 2 -years and apply under the 5 year rule. Good Luck
