Catholic Charities dropped us when we came back from California and got detained at the border patrol checkpoint in El Paso becasue we didn't file a Conditional Resident application. But they NEVER told us we needed to. So I had to hire a lawyer to get her out of the deportation proceedings. But the lawyer is asking me how I want to proceed, and I don't know what to do. THAT IS MY WIFE!!! But I don't want to be played. IT HURTS!!!!

Jean, I am paying the lawyer.

not jean. it's john, yeah I am familiar with the Pain. I was played after a twenty five year marriage, I know PAIN.............

I am surprised she isn't having more contact with you considering her entire future lies in your hands, you can easily cancel the AOS and she will HAVE to leave, the fact that she isn't even talking to you about this seems weird. Giving up after a year of marriage seems ridiculous to me. Unless there is something else that happened. I also cant believe that arguments drove her away.

Call her again and again until she answers. Find out if she is willing to get counseling if she says no, she doesn't love you, want to be with you whatever. Cancel the AOS Petition.

20/4/2009- Received NOA for AOS/EAD/AP (Dated April 17th)

20/4/2009- USCIS cashed check for $1010

09/5/2009- Biometrics

11/5/2009- Case transferred to CSC

05/6/2009- Received AP

09/6/2009- Received EAD

22/7/2009- Approved!

27/7/2009- Greencard in Hand

Removal of Conditions.

15/5/2011- Received @ VSC

23/5/2011-NOA1

12/07/2011- Biometrics

When we would have the arguments, I would try and go to her and talk to her, and I would get slapped reatedly and my face scratched. Just because I was trying to find out WHY she was mad at me for. I had NEVER touched her in that way. I did grab her arms to stop her from hitting me. And I guess since she knew I wouldn't touch her like that, she would hit her elbow or her knee against the dresser and when she did that I would tell her, "That is going to leave a bruise." And she would say "So". But I never went and reported it to the authorities.

If things didn't go her way she would throw a fit. And if I tried to talk to her and explain why things couldn't be done, I would get slapped. She would always say that we lived near my family but hers were so far away. But I have full custody of my 10 year old daughter, and not go to far away from her mother due to visitation rights. And she knew all about that from day 1 in 2004.

I am not sure what to tell you, clearly you love her, and I commend you for not giving up on your marriage right away but she is also abusive towards you and may also need some anger management. No one should have to live with that kind of thing, male or female.

Do you think she would be willing to undergo marriage councilling and anger management? Make your decision wisely though you will no doubt be paying for this and there could be a lovely woman, American, Phillipino, Australian, British, European (whatever), just waiting for you who would treat you right and love you.

You have a daughter, who you are responsible for again commend you for being a father to your daughter , she comes first and you shouldnt have to choose between your wife and your daughter.

Starting to sound like she is a bit of a mental abuser.

Sorry to hear about the state of your marriage. It does appear that you are at a crossroads in your marriage, as well as the immigration process.

If you go through with the AOS you will be liable for the affidavit of support whether you remain married or not. If you withdraw the AOS application then she may indeed adjust status, but you will not be the sponsor.

Sounds like she's willing to continue the "marriage" through AOS. Get some good advice from people that you trust.
