My friend entered the US on a K-1 to get married - the relation soured. He saw his old girlfriend who now lives in the states. They used to date back in his country. They are now talking about getting married before his I-94 expires (90 days) and he needs to leave the US. I told him that on the K-1 he needs to marry the person who petioned for him or leave within 90 days. He said that his old girlf friend spoke to a lawyer and that it could be done if they can prove it is a bonafied relationship. I told him I don't think it is possible. Any help would be appreciated. Also I was looking for other treads on this topic but didn't locate any.

He entered the US on a K-1 Visa to marry one person, the person who filed the I-129F Petition for him. I don't think he will be in a good situation if he marries someone else other than the Petitioner. I don't think he'll get away with it when he files for AOS. But I could be wrong. Tell him good luck!

05-11-2009: NOA1

05-20-2009: called the Military Help Line and requested for expedite

06-04-2009: NOA2

06-14-2009: NVC letter received in the mail

07-02-2009: Packet 4 received

08-27-2009: Interview - Visa approved!

09-03-2009: visa in hands.

09-20-2009: POE - Miami

09-21-2009: we got married!

06-08-2010: Case transferred to CSC

What kind of help are you looking for, for whom and for what purpose? There is no help for him, as his plan won't work. He can marry but not adjust status. I can't imagine what immigration help you would need. Do you think if you prove he won't be successful that he'll still marry you? Is THAT what you want?

He will have to get the new fiance/spouse to petition him. He will have to return home and wait for it. They fact that he came here to marry one person and wants to really marry someone else means he just used the K-1 to get into this country, so the original marriage plans were just for immigration. Even an idiot can see that and no way he can adjust status.

Tell him to follow the law and leave the US.

I'm not looking to marry him. He called me telling me that he is now at his exgirlfriends and that this is what he is going to do. As his friend, I think he is heading down a pathway that will create lots of trouble. A lawyer tells him he can do it. I tell him I don't think such a loophole exists. I'd like to give him some info based on fact so that he can make a decision. I'm asking has anyone ever heard if this is possible? I'm asking if there is any info that tells him it isn't possible.

if he wants to go for it then ohwell, whatever the "lawyer" said is wrong, the advices has been given you should pass this along to your friend and let him decide...

I also think if he wants to be so hard-headed and lazy, good thing you didn't marry him :) Sorry, just need to throw that out there. Short answer to the question of have we heard of anyone doing it, no. K1 is for the sole purpose of entering the US with the intention of marrying 1 person. That is why you both sign statements saying you intend on marrying each other.

if you call enough lawyers you will eventually get an answer that fits the need. they have no vested interest in the outcome. only how long they can keep the case open , therefore keeping the checkbook open...

what the "friend" has done is, commit visa fraud. any other of his intended plans will also be fraud.... PEOPLE LIKE HIM MAKE THE PROCESS HARDER FOR THE ONES TRYING TO DO IT RIGHT.

I HOPE THIS AZZ HOLE GETS DEPORTED AND BANNED FOR LIFE...
