Removing conditions, but green card got stolen

Timeline

My conditional green card is due to expire in August and I was just about to start getting ready to file to remove conditions. However my wallet got stolen out of my wifes purse and it had my green card in it.

Do I need to get a replacement green card before I can remove conditions? If this is the case that then it will hold everything up and cost me a bit of cash.

Sent AOS, EAD - 3/27/07

NOA1 for AOS and EAD - 4/03/07

Checks cashed - 4/04/07

touched AOS and EAD - 04/06/07

touched AOS and EAD - 04/09/07

RFE for AOS - 04/26/07

return RFE - 06/20/07

EAD approved - 07/07/07

AOS transfered to CSC - 07/10/07

Yes I believe you need to notify USCIS about it for a replacement by filing 1-90 coz you will be asked for it during your bio appt.

First, report to police station, get a receipt of filing the police case. Second file I-90 with USCIS. You can still file your I-751 on time, just have to include the police report plus I-90 receipt and in the cover letter explain what happened. No offense, but ASC doesn't necessarily asked for GC during bio appt., what they usually asked for two types of IDs, e.g. EAD, state driver license/ID and passport. You lost the GC, ASC is not going to give you a tough time in not letting you take the bio appt without the GC, you can't help to produce something that you don't have afterall. So file police report and I-90 as soon as possible. Hope that helps!

Please say you reported it stolen when that happened and have the paperwork to prove it. And yes, you need it.

Of course the OP needs to report it to the authorities for his/her identity protection and in my case I was asked for my GC during my bio appt.I guess its a case to case basis. :thumbs:

hehe... :P in my case, people ask for my GC every where I go, I had identity theft in March, the police at the police station saw that I'm Asian and speaking English with some accents, then they immediately ask for my GC. Of course I gave it to them to have a look, but (1) why would I go into a police station if I'm a illegal, they're acting like I'm a criminal instead of a victim, (2) even if I don't have the GC with me, they can still look up my information because I remember my A#. Also, why does people ask for GC so often? I have Asian face and speak English with accents, doesn't always mean that I'm LPR, I could be a tourist, or I could be a citizen. The police should ask for any type of identification e.g. state DL/ID or passport instead of directly asking to see my GC. No wonder people call GC the "gold card".

I remember when I first went to ASC, the guy explain to me that if I have GC, I can show him GC and driver license, if I don't have GC, I can show him EAD or passport instead of GC, for identification purpose they want two types of official government issued ID with a picture on it, not student ID or fitness club ID, in other words, they won't take SSC either because it doesn't have a picture on it.

My point: to the OP, remember to bring your passport to the police station and ASC, hope you didn't lost the passport too. Good Luck!

I too have lost my conditional green card...We are looking inside our apartment, and we cant find it. Filing for the I-90 may or may not get the card intime for the biometrics. What forms of ID is needed for the Biometrics??I still have my passport in my maiden name and drivers license.

We probably have to send the form for I-90. But on the directions page, it clearly states " You should not submit this form if you are a conditional resident and your status is expiring.:"I guess we can manage without it..But you are taking a chance with being called for an interview..You probably would need your greencard then/.

If your passport has your maiden name and driver license has married name, then perhaps it won't hurt to bring your marriage certificate as well, just in case you have to explain why the difference.

I think that sentence is to prevent confusion about the process of ROC and the simple replacement of GC due to loss or stolen. But it caused more confusion for people who needs to go through the ROC process, thinking that they don't need to file I-90 if they've already or about to file I-751. You still have to notify USCIS that the 2 yr GC is lost or stolen, by filing I-90.

Well when I went to the police station and reported it missing the dumb Kansas City, MO police told me that I shouldnt be carrying my green card around with me. When I pointed out that I am legally required to carry it with me he got very quiet and wished me a good day.

Anyway I am so sick of USCIS, with having to file I-70 plus the form to remove conditions that is going to cost over $500. I am trying to save up to go back the UK to see family and show off our newest family member that handing over the cash is going to be painful, but o well I dont have much of a choice.

I have called USCIS and asked them about this scenario. Sure the cost thing would definitely be an issue. submitting the I-90 will take both time and money. Depending on which service center you submit the application to, the ROC greencard might come earlier than even the replacement. I was told that it is at our discretion, but we will be taking a chance, if you get called for an interview, and have to produce the greencard. I guess if you make your application so strong you might not even have to worry about losing your conditional greencard.

Replacement GC does not have to be in your hands for ROC filing.

You can file for replacement GC and use the filing receipt + temporary I-551 in your passport (obtained at USCIS office) instead of actual GC.

Some people never get to see their conditional GC.
