Hi, I got married before my citizenship and getting my citizenship on this July 2009. We are planning to adjust my wife's H1B and she is expecting a baby and her due date is Sep 15th.

My question is will she get her 10yr green card strightly or does she has to go thru temporary GC with 2 yr condition and other process.

We got mrried before even I apply for Citizenship. Any comments or advice would be helpful.

08/21/2009 --- Papers Sent to USCIS

08/29/2009 --- Package delivered at Chicago 2.16 PM.

08/31/2009 --- Checks are cashed today.

08/31/2009 --- Received NOA for I-130,I-131, I-485&I-765 (Notice date : 08/29/09)

09/03/2009 --- Received Biometrics letter appt dt. 09/25/2009.

09/04/2009 --- Walk-in biometrics done today. Everything went off well in 30 mins.

09/15/2009 --- Received RFE for NABC

09/18/2009 --- Responded to RFE

09/25/2009 --- Case resumed.

10/04/2009 --- EAD Card Production Ordered

10/12/2009 --- I-131 Advance Parole approved notice and EAD Received

10/19/2009 --- Interview Letter Received for November 19th 2009 at 7.30 AM

11/18/2009 --- Interview Done

11/18/2009 --- I - 485 Touched and I-130 Touched.

12/04/2009 --- Card Production Ordered.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Actually we got married in Nov 2004 for 2.5 yrs and got seperated for 1.5 yrs and now got remarried 5 months back.

Oh Thank you. Yes we got remarried 5 months back and I added her name as current spouse and X - Spouse on my N-400 application when I applied for citizenship. I think we will be having a baby when she goes for her AOS interview.

When will your wife's H1-B expire? If possible, try to wait for another year to submit the AOS. I belive it's about 6-9 months for interview so it will pass your 2nd anniversary. That way she'll get the 10-year card instead of 2-yr conditional card. You'll avoid a lot of removing condition hessles and save some money for her citizenship instead.
