In Quebec as far as I have always been aware, you don't legally have to give any notice. You can literally up and leave. Now, its "polite" to give 2 weeks notice of course and I always have in the past.

They want 2 months to screw me, like I said. but they aren't going to get the chance. I'm giving them 3-4 weeks notice and they'll need me for at least 2 weeks while they start interviewing new people and then 1-2 weeks for me to train the new person....so haha...they will have no choice but to keep me on, even if they wouldn't want to.

Here that agency you are refering to is called "normes du travaille" for workers to complain. I have no desire to start a whole big mess with them...just want whats due to me once I leave. Thank God for my best friend who does payroll here because she'd never screw me. She's frankly thrilled to bits I am moving...now she'll get to visit me in Florida...LOL...she'll miss me but she loves my fiance and is very happy for me.

My bosses will not be "letting me go". They see it as me quitting to go to live in Florida therefore I wouldn't be able to collect any EI when quitting. One of my bosses is pretty bitter about it my leaving.

They always thought I was lying about having found my best friend from high school in Florida on Facebook and reuniting with him and falling in love. That was until I said I was going to Florida for a long weekend and then a month later he was up here to visit me and they met him.

Then it became a battle with everything at the beginning. My one boss left me alone about it, just randomly asking me how everything is going, genuinely concerned.

The other boss is an A** about it. Sneaking behind my back, asking other people in the office if they know my plans, trying to get stuff out of my best friend, coming to me and telling me I HAVE to give him 2 months notice before I decide to leave....its all very sketchy which is why i am keeping everything on the down low.

The day I go for my medical will be: " I have an appt. with my general practitioner", and any other little appointments I may have related to the visa like going to the translator will be done on my lunch hour so no one figures anything out.

The day of my interview will be: "I have an appointment I have to go to but will be in the office before lunch time."

Well you can still quit and collect EI in this case from what I've read. Because technically your reason is because you have no choice but to quit and relocate to be with your spouse. I would definitely still apply, I wouldn't count yourself out! I'm going to ask my employer to write "relocated for spouse" on my record of employment, but if they don't, I bet that would still be okay.

Oh yeah, don't rule it out because you quit! I quit too, my ROE stated no such thing about reason for quitting due to relocation for spouse. I was approved, so I don't see that being a problem.

I just figured I couldn't collect EI if I was living in the States as well. Is that possible and I was just misinformed?

Yes! Many of us collect EI when moving to the US, it doesn't matter. Now, lately alot of people on K-1s have been getting rejected, so it's not a guarantee you'll be approved. But it's worth the try!

So is it that once you get your work permit in the States is when you would contact the Canadian agency to stop the EI?

No, once you get a job you would inform them to stop the payments. You are eligible to collect for a full year. Not sure if you've looked at the "EI" thread pinned at the top of this forum, but it has all the info you need to know about applying for EI!!

Definitely apply right after you move. You may not get approved until you get your EAD, but once you get your EAD, you should be able to collect it.

So at least if you don't find a job right when you get your EAD, the EI will help to hold you over.

I have always worried about debt and such for years, Carnell is more laid back and one day he turned to me and said "Lo (short for Love), why are you so worried it will all get paid back one day, or we will die - please stop fretting." I still backside and worry sometimes. I know I will have some debt when I leave Canada and I will have enough saved and through EI to carry me until I get a new career in California. I wanted this so I wouldn't have to rush into accepting a job that I really didn't want.

So yes, I worry but I am not loosing sleep anymore. :)

Two things jump out at me while reading this thread. One is yours JillA that says "now, lately, alot of people on K-1's have been getting rejected..." What can you tell me about that? It may be because they're not following the rules, but I'd sure like to know why.

The second comment was the OP saying because she was quitting that she wouldn't be able to get EI, and minnew saying that she didn't think she could collect EI until her EAD.

domegirl, yes, you can quit, and it can say you quit on the ROE...and don't wait for the ROE before you apply either. You've quit to relocate to the US to marry your husband, or live with your husband, so you can collect EI.

minnew, I did hear that people are not eligible for EI between their arrival date in the US and their EAD now as well, however two things to keep in mind. One is that you have to apply for your benefits before 30 days are over from your leaving your past job. You should apply for your EAD as soon as you get married, it shouldn't take that long to come in, much faster than they've been in the last few years anyway, and you'll get your monies backdated (minus 2 weeks), from your EAD approval date.

Sorry this might be a silly question but what do you mean backdated from your EAD approval date? Do you mean they'll backdate payments from the period that you quit to getting your EAD? I just want to make sure I get what your're saying :)

so i called service canada just now. i am here in canada on a work visa but i pay ei and the other stuffs that a canadian pays. i asked the lady if i will bable to be grant a claim and she said that i she cant give me an answer until i filed for a claim.

this is her instruction:

1. file for a claim online when you're already in the usa.

2. fax a copy of ROE from canada and any document from the usa that says i am able to work e.g. greencard, ead blah blah..

questions:

you file for ead after you get married right? and then wait for 3months or so to get it?

you should file a claim for EI within 30 days of your last employment?

so how can i give them an ead if it will take me longer time to wait for that than filing an ei?
