Hi everyone, I'm new to this site and hope I can get the best advice....

I'm a US citizen and I've been dating my boyfriend since 2005. It's been a long distance relationship all along and we've seen each other in person every year. Last time he was here was Feb. 8th and a couple of weeks ago I discovered I'm pregnant. We have decided to get married, and want to decide for the fastest process. Should I start on the K-1? or let him come on a tourist visa and get married here? We want to be together during these important months of our lives asap but I'm worried that if we get married here it's going to be seen as fraud. What steps should we make??? Please help :(

People get away with marrying in the US and staying even tho they planned to when the beneficiary entered. Yes it's fraud.

Best to do a K1 fiance visa.

Oh my, I was hoping that getting married here without doing K-1 was possible due to my pregnancy. I wouldn't like to have my baby with him being away. :crying:

There really is no easy answer for you. I can imagine that being pregnant and away from the father of your child and the man you love is a very difficult thing. However, just because you are pregnant does not mean he can circumvent the immigration process and gain easy and quick entrance into the USA. Unfortunately he will have to go through the same procedures as anyone else. The K-1 visa seems to be the quickest route to the US, which is generally 6-8 months as others have noted... but can take longer depending on many circumstances including but not limited to what service center you use and what embassy you're fiance is going through. Spousal visas like the CR-1 tend to take longer but allow the beneficiary certain privileges not offered to K-1 applicants upon arrival to the US (the right to work almost immediately for example)

It is not illegal for your fiance to enter the US on a visitors visa and marry you, however it is illegal for him to stay and adjust status if he had the intent of staying upon entry. It will be his and your burden to prove his intentions were not to stay when he entered, which seems very difficult to do since he would have intent to stay.

Keep in mind that your fiance can come and visit you on a visitors visa while his immigrant visa is being processed. This means that he can quite possibly still see the birth of your child. All is not lost! Congrats on the pregnancy and I wish you luck with whatever you decide!

Getting married is absolutely possible. It just doesn't mean he gets to stay any longer than any other VWP visit. If you want to marry before the baby is born, do that on a visit, then start the spouse visa process. K1 is the fastest way to be together, not the fastest way to get married. Most of the pre-visa married folks here are living in separate countries.

How much longer than the K1 visa the CR1 takes? Would it be more convenient because he will be able to work immediately and I'm going to need his support economically? If we decide for the K1 after how long can he work?

A very rightful worry, given you are pregnant and have a 5 year relationship how would you convince anyone he came on a tourist visa with no intent to marry?

The K-1 is the fastest way to get him into the USA and get married. It is not the simplest, or fastest in the long run (to finish the process) but if your goal is only the fastest route...K-1

He can go to you and get married no problem. He will have to return when his visa to visit you expires. Then once you are married you two can go either the K-3 or CR1 visa route.

So many choices here, I don't know on which to decide.... K1, K3 , or CR1?

Whats the difference between K3 and CR1? They seem kind of similar to me

He would like to begin to work as soon as he gets here to help me economically, so whats the best choice for that?

You have several options, and only you can decide which one is right for you, after reading the guides on here to find out more about them and talking to your boyfriend. Forget about the K3- it used to be faster than the CR1, but not anymore, and it means he would need to adjust status when in the USA, so couldn;t work for a few months. K1 would be the fastest option to get him to you, but at this stage, it is probably too late to get him there for the birth, plus it will take several months until he can work. CR-1 means he can work right after he arrived, but you'd need to be married to apply for it, plus it usually takes a couple of months longer than the K1. Technically, he can still visit while you are in the process of applying for an immigration visa, but in reality, this is difficult and people often get turned back at the border, especially if they are from poor/ high fraud countries.

From what you have told us, your boyfriend has a tourist visa? Here is what I would do: I'd have him come visit on his tourist visa for the birth of the child and to help you for a few weeks/ months. If you wish, get married during that time (getting married on a tourist visa is ok, staying in the USA after the wedding is NOT). You can apply for the K1 or CR-1 visa while he is in the USA to shorten the time apart, just make sure he does not overstay his tourist visa. Then have him go back to his country and wait for his K1 or CR1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
