Hi,

I normally write under “jesussman” but forgot my login so I registered again under “jesussman2” :D

I came here on a K3 in late December 2005, was going to go the CR1 route so I only applied for an EAD and SSN which was processed and came through in April 2006.

Since then we’ve decided to do the AOS here in the US instead (we live in New York) so I have some questions I would very much appreciate some help with.

1. To those who are familiar with the I-485 Form, under part 2 it states: I am applying for an adjustment to permanent resident status because: and then it gives options from a)-h). I am not too sure what to put down as I am neither a K1 nor a K2 holder as option c) states. So what should I choose?

2. Biometric service: As I already did biometrics for the EAD; do I have to go through that again? (plus pay $70 for it again) or will they have my fingerprints, signature and photo on file?

3. Medical exam: As I came here on a K3, I was required to have a medical exam in my home country (Iceland) which I have a copy of. Is it enough for me to submit that copy? Do I need to see a civil surgeon to fill in the “Appendix A”, Supplemental Form to I-693 or do I have to go through all the medical exams again?

1. Check "other" and I put " I entered as K3 spouse of a united states citizen."

2. Yes you have to pay $70 for biometric and you have to do the fingerprints for AOS.

3. Medical exam is valid for one year. if your medical is still valid then you just need to submit I-693A

(Vaccination Supplement) you can bring your shot record to designated civil surgeon in your area and ask to transfer it to form I-693A.

Sigrun,

1. Option 1, you are adjusting on the basis of an approved I-130 immigrant petition.

2. The 'biometrics' for the EAD is not the same as the biometrics for adjustment of status, it is more intensive and high-tech and it costs $70. (You paid an extra $70 for the EAD? And they didn't send it back to you? Yes, I know what the I-765 instructions appear to say... If they've taken the fee once you may not be obligated to pay it again, but if that's the case I don't know how you're going to get around it.)

3. If the date of your visa medical exam is within 1 year of the date you submit I-485 then you do not need another exam. You may nevertheless be required to obtain the vaccination supplement.
