Ok... dumb question. I'm just married and I and the wife are filling out her AOS documents. On the I-485 it asks for 'Application type' and to check one of several options. I know sometimes things aren't as plain as they appear so I figured someone could tell me which one of the many options to pick. These two made the most sense: I am applying for an adjustment to permanent immigrant status because: 1) an immigrant petition giving me an immediately available immigrant visa number has been approved or 2) Other basis of eligibility_________. Option 1 is only for K visa holders mostly right or I don't know? Or do I select 'Other basis' and list the F1 visa there? I know this is important to get right. The other several options seemed fairly clearly not to apply. Any help would be greatly appreciated so I can get this packet completed this weekend!!!

if you have filed or will file an I-130 petition with the I-485, then it is #1 as the I-130 petition will determine eligibility for an immediately available visa number

No select other option and state F1 visa.

Number 1 is for AOB from an immigration visa (k visa), you are here on a F1 visa which is not an immigration visa....so 1 is not an option for u.

Came to the U.S on a F1 visa January 2008

Got engaged to my USC girlfriend Dec 2008

DEC 29th 2009 Married

JAN 27th 2010 Medical completed Jan 27th

FEB 17th 2010 AOS + I-130 package sent

FEB 25th Got emails with all receipt # ( but not able to check on USCIS site)

FEB 28th Online status check available

MAR 1st Received Hard Copy of NOA's in the mail

MAR 8th Received Biometrics appointment in mail: for Mar 18th (however no updates on site or email notifications)

MAR 9th Biometrics complete via walk-in (All docs touched on USCIS site)

MAR 26th Received interview appointment (For May 6th)

APR 23rd Touched on I-130 and I-485

APR 26th Touched on all docs, EAD card production ordered

MAY 1st Advance patrol in mail

MAY 6th Interview (Request for additional information)

MAY 6th EAD in mail

June 1st (RFE mailed in)

June 28th Notice of approval on USCIS website

July 3th GREEN CARD INT HE MAIL!!!

an F-1 by itself is NOT eligible to adjust... putting "Other" with F-1 will result in a denial. #1 is the only option and the I-485 MUST be accompanied by an I-130

Thanks for the feedback and quick responses! I read the I-130 and it seems to make sense. So... option #1 then? Are we pretty sure? I don't want a denial!

I am not a lawyer.

Your F-1 is non-immigrant. An immigrant petition is what you are filing for so a. with I-130 sounds right.

12/10/08 - Sent I-130/I-485/I-765 from VWP

12/16/08 - Received

02/13/09 - I-765 Biometrics

02/17/09 - I-485 Biometrics

04/23/09 - Interview - Approved!

04/27/09 - Card production ordered

05/02/09 - Welcome to America letter

05/06/09 - Green card received!

05/25/2011 --- NOA1 received

06/27/2011 --- Biometrics

10/17/2011 --- Approved! confetti.gif
