It has been a year into the AOS and no interview.

My wife overstayed. We met and got married. While bringing back to Texas she was picked up and was released on a bond and applied for AOS. We are very happy, but was wondering if anybody had similiar experiences. Did it take longer because of the overstay and/or because she was picked up. Just curious if there were others out there going through the same experience.

we didnt have any problems like u but ours did take about 9 months til we got our interview notice then it was cancelled and didnt get rescheduled until 3 months later. they said our file didnt get to them so thats why they cancelled. but it did take a year to get the interview.

I'm a little confused. What visa did she overstay? Why did she leave the country knowing that she had overstayed? What was she "picked up" for? Why did they allow her back in, knowing that she had overstayed?

Someone can correct me on this if I'm wrong, but it's my understanding that if you leave the country after you have overstayed, you incur a ban from the US based on the length of overstay. To apply for AOS, you have to have entered the country legally.

I think we need more info here.
