obtain vistor visa while I-130 at NVC

Hi guys,

I bet this question had been asked so many times.....well however I dont find the answers i need...so sorry about asking again :P

Ok since I dont have a flat and a job by the end of july anymore I was wondering if I could get a visitor visa to stay at our house in the US till the interview is scheduled in Frankfurt. I mean what am I supposed to do? The problem is that I dont have any ties to Germany anymore (well no flat no job) so #######??? I dont wanna take the risk entering on the VWP cos I would of course stay as long as possible (so 89 days. I mean what do they think? I am going through all the goddamn procedure and got approved and then I wanna enter the US to stay there illegally??? Huh??? Doesnt sound realistic to me.

Any advice is appreciated.

01/20/06...married

02/28/06...NOA1....I-130 VSC

May 2006..Medical in Frankfurt

06/14/06...I-130 approved via email [day 111]

06/19/06...NOA2....I-130 received via mail

07/10/06...talked to embassy to expedite the process

07/12/06...NVC stated case completed and sent to FRANKFURT[day 147]

07/17/06...received packet 3 from embassy

07/29/06...received packet 4

08/15/06...INTERVIEW at 7:30am- APPROVED

08/21/06...VISA received

08/23/06...Flight to US

08/23/06...I am back home

09/20/06...received greencard in mail

09/27/06...received SSC in Mail

09/23/07...our daughter was born :)

30/05/07...filed for Removal of Conditions

07/05/08...received NOA for I-751

01/07/08...college here I come :)

waiting for biometrics and Approval.....

Timeline

From the look of your timeline every bit of personal information on you has already been entered into the USCIS and DOS computer databanks including your passport number. If you do not already have a visa I think you are asked if you have ever applied for a visa of any type when you do apply. What will you tell them then? You have applied for an immigrant and non-immigrant visa via the I-130 and I-129f and they know it!!! It is my humble opinion you will be wasting your application fee.

true...visitor visa would be stupid *lol*. What if I travel on the VWP? I used it back in February to may to visit my hubby. I have one strong tie to Germany and that is the Approval notice of the I-130.

Well the VWP is an option whereas a B-2 visa is not an option. But if the CO does any checking at POE he or she will see you in the computer via your passport number anyhow.

I just called Customer's and Border Protection in the US and was told the following(btw he was a really friendly man):

- do NOT come over until you have the stamp in your passport and received the package from the embassy they gonna give you a whole bunch of problems at the POE

- let your husband call the US embassy in Germany to tell them to speed up the progress (hm i dont know why but ok....he says because he is in the military that would be an option)

- since we have already filed in February he said that the embassy can do something about it.

So ok....I will let him call the embassy.

Well I hope for your sake this guy knew what he was talking about. He is saying your husband can call the embassy in Germany and ask them to expedite processing of a case that is still at NVC because your husband is in the military? Hmmm.....

Isabel,

The B2 visa and the VWP are for the purpose of visiting the USA. They are not for the purpose of immigrating in advance of obtaining approval to immigrate. It appears that you wish to do the latter but call it the former, however the consulates and CBP call it what it is.
