how long does it take to recieve her K-1 visa after you file for it? my fiancee and i are getting married this month but are a little scared because I'm here with a tourist visa, attended college for 4 years herein the US , when i graduated i applied for OPT and worked here for a year, it expired december 2008 and came back to the states february 14 to help my bestfriend plan her wedding and look for colleges to do my masters degree, while being in the States my fiancee proposed and we decided we want to get married... Please let me know how long it take to get a K-1 i don't want to risk case!

Whoah, slow down.

You say that you are getting married this month.

In that case you CANNOT apply for a K1 visa. K1 is ONLY for unmarried fiances.

Please use the Guides (look at the top of VisaJourney web page) for more information about which visa is most appropriate for you. If you get married, you will most likely want to file for a CR1 (assuming you will return to your home country to wait out the visa process), or you may be able and want to do an AOS (Adjustment of Status) from your tourist visa in the US. In that case you would not be returning to your home country. Be careful about the AOS option - you must be very certain that when you entered the US you did not have any intent to marry. Be prepared to prove that.

The timelines for any immigration process can be lengthy, typically many months and in fact it is years to complete the entire process including removal of conditions and possibly naturalization. Be prepared to have lots of patience.

The number of questions isn't the problem. The fact that she seems to be proceeding to file for K-1 along with documents that indicate she's trying to do AOS in the US is the problem. She needs some competent hired help to make sure the right documents are being sent off.

Yes, people are trying to help you. Scroll up to the top of this page - you'll see that I have tried to help you too. I and others will be happy to continue trying to help you. All I would ask is that you not open multiple new threads every time you have a question. You've opened more new threads in one week than most VJ members do ever. Not that there's an extra cost to threads, but this is highly irregular and is considered poor netiquette.

All right, I withdraw my comment of 'spamming'. I'll give you the benefit of the doubt that you are unaware of how message boards typically operate.

Good luck. Do some research - you seem to have a lot to learn about the immigration process and you should be careful before you make any serious missteps which you could regret later (e.g. filing a K-1 as a married person, or filing an AOS if you had premedidated intent to marry when you entered the US on a tourist visa).

sigh... what ever... according to you i don't know how message boards operate... i never said i was going to apply for K-1 as a married person i was saying we don't know if we should just apply for k-1 and then get married... or just go ahead and get married and Adjust my status. and seriously.. stop being so rude...

Honestly, I would suggest hiring a lawyer. People here Are very nice and helpful, but only a qualified immigration attorney can really help clarify the peculiarities of the immigration process, as well as the advantages and disadvantages of a certain way ( K-1 vs. AOS). and they will answer all your questions and help fill out the forms.

And if that`s not an option, I would suggest doing a thorough research and Read whatever you can on this And other sites with regard to your opportunities. And THEN, if you still have questions, we`re here to help
