1. Do I fill out a DS230 or just my husband, the beneficiary?

2. If our interview is after April 15, will they expect us to redo our I864 and add our 2005 taxes?

1. Just the beneficiary who is now the applicant for the DS-230

2. They will require the 2005 after 15th April.

1. Only your husband fills out the DS-230.

2. I think they will. The cut-off point is somewhere around April 1.

The DS-230 clearly states that it is an application for an immigrant visa and alien registration. Do you need an immigrant visa or are you an alien needing registration?

If you do not file an extension, your tax return is due on 4/15/06. USCs abroad are automagically given a 2 month extension, btw. There is another 4 month automatic extension that can be filed as well. (details on both at irs.gov) If your tax returns are not yet leaglly due, you do not have to present them for the Consular interview.

The DS-230 clearly states that it is an application for an immigrant visa and alien registration. Do you need an immigrant visa or are you an alien needing registration?

(details on both at irs.gov) If your tax returns are not yet leaglly due, you do not have to present them for the Consular interview.

Technically your tax return is due April 17th this year if you owe. As far as the IRS is concerned you can take longer if they owe you. I think it is an additional 2 years. The government will happily earn interest on your money and if you take too long they will happily keep it. That said, for immigration purposes, they would prefer you use 2005 if you can and some time in April they will mandate it.

Thanks for the replies, everyone. I don't care about OUR taxes, I'm just annoyed that I have to put my mom (she's our joint sponsor since I'm living in Canada with my husband) through all this again with 2005 tax transcript, another W2, and ANOTHER I864. This whole immigration process makes me want to rip my eyebrows off.

thanks for asking that....i was curous about the 2005...mine and sofyans interview is march 21st, so i think were clear with just 2004
