(L)(L)(L)(L) I married my love on June 17. It was the most perfect day and night :blush: now I have to get back down to reality and continue with the paper work :crying: , where do I go next.

I noticed his K1 and temp work EAD expires on July 27, but I see to file the AOS. u need the marriage certificate, which will not arrive for another 5 weeks. This will pass the deadline and he will be out of status, had anyone ran into problems with this. Also he already got a job, is there anything I can do when the work authorization expires, what trouble can he get in if he continue to work while waiting.. Please help :help:

I thought I read somewhere you can get the EAD extended for one year???

The TEMPORARY EAD that is given at the POE is good only for 90 days. You might be thinking of the permanent EAD that can take about 45-90 days to get after filing for it with your AOS.

In New York it is illegal to bring the completed marriage license to the city office, as recommended to expidite the process of getting it faster. It must be mailed by the cleric who married you to the city office and then sent to processing, they said it ws no way to speed it up.

New York City is notoriously slow in processing marriage certificates. THis is way many people who have K visas and the like opt to get married elsewhere where they can get a certificate faster..

But to answer your question, the I-485 does not need to be filed by the expiration date on the I-94. You only needed to be married by then. However, time between the date that the I-94 expires and the date that the I-485 is received by USCIS is considered time out of status. Accumulating more than 180 days of such time could cause problems.

Your employment authorization associated with K1 status expires when that status expires.. the date on the I-94. You will not be work authorized again until the EAD is approved. About 4 months after the I-765 is received by USCIS.

First of all.. Congratulation on your wedding!!! (F)

Well.. as zyggy said, you do not need to file your AOS paper before 90 days.. but it is adviced to do it ASAP. During the time you wait for the Marriage Cer. you should gather all papers and fill out all the forms so when you receive the marriage cer then you can just send it in. that way you wont be out of status for too long :D

As for temp EAD.. after the temp EAD expires, he should not be working, and wait until he got the EAD. In this case he would be waiting for quite a while since you would normally file EAD with your AOS. and it can take up to 3 months after you file to get the EAD. it can be faster...though.

I do not know what will happen if he would continue working while temp EAD expired and waiting for EAD. But i wouldnt risk it. they can find out very easily if he's working or not.

K-1 = 4 months

AOS = 5 months

May 18th tranfer case from Seoul to Islammabad

June 21st security clearance done

June 28th online at the embassy in Islamabad

waiting for paper transfer and the good word

OCTOBER 14TH 2005 Interview Number 2: ISLAMABAD, PK

AR number 2 sent to DOS per Islamabad (2 cable request)

Nov 22 okd updated financial and etc proof accepted / embassy waiting for security cables

dec 20th one cable back waiting on 2nd

Jan 17th.. good word recieved. SECURITY CHECKS ALL CLEAR!!! DOS says embassy to contact him within two weeks!!!!!!

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

FEB 28th WELCOME HOME>>>POE CHICAGO did not even look at xray, few questions. one hour wait at Poe

march 10th marriage (nikkah at the islamic center)

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Is the EAD only issued at the POE in NY or JFK? My fiance arrived through Houston and was not escorted through immigration once he arrived from Vancouver. Did we miss the EAD request somewhere? Can we go back and get it? Who do we contact for more info?

Wow, that sucks! In Florida I just took the Marriage Application sign to the court house and I got five Marriage Certificates right on the spot.
