My wife from the Philippines arrived in the U.S. on Dec. 10. We applied for her SS card on January 19 in her maiden name....then were married on Jan. 21. We will be applying for her AOS and AP this week. On Feb. 3, we went back into the same SS office with our marriage certificate and she was allowed to change her last name and order a new card. The second card arrived yesterday, Feb. 11...only took about a week....first card in her maiden name still hasn't shown up!

Keep in mind that we still haven't filed for her AOS and don't intend to file for her EAD, just her AP. Our experience kinda shoots a hole in previous discussions on here concerning the SS application process. At least at this one south AL SS office, we did not have to have any NOA's, EAD's, or any other document from the USCIS to get her name changed after marriage. We only showed them a certified marriage certificate.

I have to wonder if we had just waited until after we were married, showed up at that SS office with our marriage certificate and her visa, passport, I-94, and birth certificate, would they have ordered her SS card in her married name? Guess we'll never know, but at least my wife has her new SS card, which completes another small step in this whole complicated process! Now bring on the AOS/AP!!

The lady at our local office said that we couldn't change Claudeth's name until we received something from the USCIS in her married name. When she got her EAD we went back. It took about six weeks to get her new card.

We all seem to have filipina wives! Woo Woo

John....thanks for your reply....it seems our timelines are running almost the same! My wife is from Leyte and we live in northeast AR. Good luck with your AOS!

It is my opinion that there is no set SS rule saying that in order to get the SS card with married name, that you have to submit a USCIS document with married name, such as the EAD. I think it varies according to the policy of the SS office you're dealing with....and perhaps even the SS office person handling your case.

Does anyone know of a published SS rule stating you must submit a USCIS document with married name in order to get the SS card with married name?

Well if they processed her name change application without her providing proof of work authorization. i.e. the I-94, someone f**ked up big time. Did the mariage certificate have her age or date of birth? If not then that's a double f**k up.

Even though it's not the right thing to do, if the card in the maiden wasn't issued they might have seen that application was still pending and had seen the I-94 for it and deleted the application and input the info from the new application. Did she get a reference number for both applications or only the first?

Since, she has her SSN call the SSA 800# (800-772-1213) to see if the card in the maiden name was issued.

No telling what would have happened if she had waiting to file until after getting married. She did the right thing by applying with the maiden name first. The odds were in her favor of geting the SSN the fastest that way.

I agree that the safest way is to apply before marriage. Otherwise, people may get stuck waiting for EAD like very many on this forum did (including myself).

Having the number is much more important, even if it's in the maiden name.

She submitted all the correct documents for both visits. On first visit she submitted her passport, visa, I-94, and birth certificate. On second visit she again showed them all the stuff from the first visit, plus our marriage certificate, which does have her age and DOB on it. The new card does have "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" stamped on it, right above her number.

hELLO THERE! got Ss card with my maiden name and after marriage i applied for name change before filing my aos&ead,i just submit my I-94 and marriage certificate no hassle at all. After one week i received my new SS card with married name.

I have a question, front of my SS card written valid only with working authorization papers? is it the same with your wives ss card?

I am a filipina too from Isabela (northern part of the philippines).

It almost makes you think that the SSA offices in each state are state run services instead of a governmental agency, considering the wide range of experiences and requirements to get the SS card. I understand different classes of visa have different requirements, but most of the comments I am talking about are from K-1ers, in which case every SSA office should be acting the same way in regards to getting the card. But, let me wake up from the dream of sensibilty and return to the real world of #######.

My wife applied on the 2 week mark (Jan 10) with no problems (only needed her passport with the visa and I-94 in it), recieved the card in the mail in 6 days, and we applied for a name change card on Feb 6 with her passport and the certified marriage abstract.

The clerk at the SSA office did try to turn us away at first saying that since Marlene was already married, she no longer qualified to get the SSN without an EAD. I put up a fuss ... asked her to show me that rule. She said she'd input the request and put her maiden name in "other names used". Marlene was issued the card in her married name.
