I guess USCIS are inconsistent...(duh...they are)....because when i first filed i just sent them a copy of the one the pastor signed, with my hsband and I and witnesses signatures...not a copy of the official one with the seal and i didn't get an RFE...I knew a few people who filed and did the same thing because they didn't want to wait for the official copy to file....nonetheless atleast they are working on your file...you've been going through this for a long time...i remember you from when i was filing cause i think we started around the same time...

UGH!!!! I pray it is the marriage license and nothing else. That is my fear. I keep going over and over in my head of what it could be, since our case is a bit unique, "long story" I will know soon, 90 more minutes and Im homeward bound. Thank you for your kind words, and yes, I kind of remember your name. It will all be resolved over weekend, that I will see too.

None the less its good news, lol its funny to say congratulations on a RFE, but I will say so, because you know it that once RFE is sent, its only a matter of a week or so before you get your approval :) so keeping my fingers crossed for you.

Sorry to burst your bubble, but that's not necessarily true. VCS Received my RFE on 04/16/09 and still nothing. They can take up to an additional 60 days. Sit back and relax, because this is a long ride.

Been there, done that with VSC last year, CSC is a walk in the park compared to my nightmare last year at VSC. We will get thru this, that is for sure. Good luck on your RFE hope VSC processes it real soon.

Well the good feeing I had today was blown away, instead of NOA 2 I got RFE.

I called USCIS and RFE was issued May 2nd, but still not received in mail today. But I think I know what it is, I sent in a copy of marriage license, and not the Recorded/Filed with courthouse. And that is okay, Im ready to send to them overnight.

Funny part when I realized what I did, as soon as I got NOA 1 I sent them the recorded copy of marriage license with my NOA 1 copy, guess they USCIS never matched it up.

Oh well, that is where I stand.

Okay got home and no RFE in mailbox. Funny thing, when I found out about this I swear the lady said it was not mailed yet, so this haunted me and I called back, got a officer , he said could take up to 30 days to receive it. Said they do mass mailings, so maybe tomorrow mail will bring it. I asked what it was, and said against regulations to discuss reason over a public phone.

Just blew me away, 30 days, cant talk to me about it? WOW. Anyways, sure more of this saga will continue.

Hope somebody here could enlighten me out on this. When I was still a permanent resident, I got married and immediately petitioned my wife (I-130) and wrote in the application form her maiden name instead of her married name. My understanding that time when I was filling up the I-130 application form was I had to follow what is written in our marriage certificate so that USCIS could match the name of my wife in the application form from the marriage certificate.

Now my concern is, whenever I will upgrade my wife's case from I-130 to IR1 soon, will it be a cause for concern if what appears in her record was her maiden name instead of her married name? She'll be issued a lawful permanent visa entry with a maiden name printed on it but her passport and related documents such as police clearance etc. show her married name already and perhaps immigration officials may question why those don't match.

In connection, as we prepare to upgrade my spousal petition after I take oath, shall we write her Married name in forms DS-3032 (Choice of Agent) and DS-230 (Application for Immigrant Visa and alien registration) or write her Maiden name as what was printed in I-797 (USCIS Notice of Action 2)? But then again, like what I said this is the dilemma, that if I follow what was printed in I-797 and write her Maiden name on prerequisite forms such as DS3032 and DS230, her documents such as passport, police certificates etc are all written with her Married name.

Is there someone here who had the same experience? What transpired in your case? What are the things to do? Or it's not a concern at all since I had the marriage certificate to prove anyway? Thanks.

Hope somebody here could enlighten me out on this. When I was still a permanent resident, I got married and immediately petitioned my wife (I-130) and wrote in the application form her maiden name instead of her married name. My understanding that time when I was filling up the I-130 application form was I had to follow what is written in our marriage certificate so that USCIS could match the name of my wife in the application form from the marriage certificate.

Now my concern is, whenever I will upgrade my wife's case from I-130 to IR1 soon, will it be a cause for concern if what appears in her record was her maiden name instead of her married name? She'll be issued a lawful permanent visa entry with a maiden name printed on it but her passport and related documents such as police clearance etc. show her married name already and perhaps immigration officials may question why those don't match.

First ..thats not the right place to put such an iquire ...u can make a thread for it ..tht make it more public and will help u more ...

i will answer some Questions for the sake of helping u after all

first : YOU DONT updare ur wife case to IR-1(IR-1) IS the visa tht u r wife gets if she is to enter the US after the 2nd Anniv of your marriage togethr

Second : USCIS care tht HER NAME at the marriage time (the Maiden) should Match the Marriage certificate one ..so u r good to go ....

Third : u upgrade the petition upon being USC at once ...and then on DS-3032 and DS-230 it should carry her NEW MARRIED NAME cz the name she write in both forms is what will be used in the stamped Visa BESIDE ...theres a field tht will ask for OTHER NAMES USED ..so she can mention all her earlier names if Any ..
