My brother's wife is from Australia. Is it best to wait til she comes to stay with him before filing the CR-1 for permanent residence or he can do that now while she's still in Australia? Which form is best CR-1 or K3?

Nowadays processing has become more consistent, so I would go for a CR-1, because you might save a few weeks with a K3, but you can wait up to a year for the green card when you go to adjust status. I had similar questions, but the representative at USCIS said just go with getting the full permanent residence upon entry to the country after the approvals instead of getting here a few weeks earlier. I think it's worth it. Take care.

I agree but start with the guides and learn the process. Neither CR1 or K3 are forms. K3 is a virtually obsolete visa category and CR1 is both a visa and a status.

Can he wait till she moves to the states before he starts the CR-1 process or it's better he starts now while she's still in Australia?
