A couple acquaintances of ours had their AOS interview this morning. The guy is a Turkish citizen who came here to the US on a student visa. He then met & married a USC and they filed for AOS based on their marriage. My husband went with them to their interview as an interpreter (the guy speaks little English). My husband says they interviewed the man and wife separately and apparently there were a few discrepant answers regarding things like tatoos....he knew how many she had but maybe misdescribed what they were etc. They werent given a yes or no answer at the interview and were told they would receive a letter in 30 days. Now they are wondering if this is normal or not and if they didnt pass the interview...is there any appeals process?

Thanks so much in advance to anyone who can help me help them shed some light on the situation!

Tanya

sorry to hear this

seems the IO is not happy with your friend's paperwork at the begining, normally will be questioned together at the start.

Once the IO decide to give a denal notice, the allen will be informed to have hearing within 30 days, that's the only chance to let the judger belive it's a bona fide marrige, if so GC will be no problem. If the judger doesnt belive, your friend will face to a depotation immediatelly

For now, your friends have to prepare more evidence and witness,to fight again in the hearing.Hope this will not happen and your friends will be appoved finally

Lets not get carried away. Lots of people are not informed of their decision at the interview and still receive a green card. Gathering more evidence is not a bad idea, but they should not assume they will not be approved. You can't tell very much from the attitude of the IO.

Concur - I wouldn't worry about it till you see the letter in 30 days or so.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
