hello I'm back here! need answer to my question.

We got here last December through K1 and my I-94 expired on march 18 2009 now I did not file for SSN because we were waiting for our marriage which was last February and we want to have my marriage name in my SSN. then after February...March....April we keep waiting for our marriage license and we keep calling the court house if our marriage license is ready but they said they don't receive the form and they advise us to call who ever officiate us, and then we found out that the Pastor forgot to mail forms to the court house and to make the story short we just got our marriage license today finally!!!!! :dance: :dance: :dance: Now.... were going to file for my SSn tomorrow but one of the requirements if I-94 unexpired :( now what should we do? my I-94 already expired almost 2 months ago...guys we really need some help here if anybody been into this situation please let us know what you did..

Well, you will egt what you wanted. For the reference of others

K-1s can get an SSN right away. Don't wait. The name omn the card makes absolutely no conceivable difference and you can change it after AOS if you want. Also the "DHS authorization required" makes no difference. EVERYONE including citizens needs "DHS authorization" in addition to an SSN.

I LOST my SS card in 1973. I never replaced, I never needed it. It is a singularly useless document and could say anything or nothing, it is NOT acceptable identification for virtually anything. The only thing important is the number, which never changes regardless of name change.

For K-1s, apply for the SSN the next business day after you arrive. Insist the card be processed, if the clerk gives any trouble, get a supervisor. There is no need to wait two weeks, you can have your card in hand in less than one week. Don't worry about name changes, you have all life for that.

1. Get the SSN

2. Get married

3. Get green card

4. Change name on SS number if you want

My wife did not change her name, her card still says DHS authorization required (or whatever the phrase is) and it is safely tucked in the bottom of her sock drawer where no one will ever see it.

Oh, and now you will have to wait until you have your Green card or EAD for your SSN

I got my SSN before marriage but when I went there to change my last name they told me that they can't change it because what they need is the I94 which is expired. The lady told us we had two option. First, go to DHS - Immigration to extend it so they could change it and second it to wait for the green card. She also said that I don't had any problems with it cause I already had SSN.

I got my SSN the same as you. After marriage, there was less than 15 days on the I-94, so they wouldn't reissue me a new card until I got my EAD or GC. At that time they took off the "Not Authorized for Work" clause as well.

SSN is always needed for any application such as driver's license, employment, bank account, medical insurance, etc. which some of the documents are needed for the AOS (if u have interview). Do not take it as no sense. If you will be applying for work, the employer will always ask for your SSN and do a background check.

If your I-94 is expired, I'd rather wait for the EAD before applying coz definitely the officer will not grant you the number unless you can provide a valid certification (EAD or GC) of your stay in the US. Waiting for EAD after filing is approximately 2months, not that bad. I should say the Pastor awes you apology for delaying your marriage cert. :luv:

Is there anything you need the SSN for before getting the EAD? I hear some states require a SSN to marry you, but if you're already married, then what else do you need the SSN for, before working?
