I am getting ready to attend the interview with my wife in Manila. I have been having trouble understanding the I-134 & I-864.

For one I had no job for 6 months of 2004 and my income of that year fell below the 125% level. Since then I have been doing better then ever. Will that one year affect their decision? Or will they go based off my 2005 Returns?

Two, they say notarized. Do they require the seal on the documents, you know the one you can touch and feel on the paper, or is the ink stamp ok? The ink stamp that banks now use for example.

Manila wants 3 years of tax returns, so I assume that 2004 will affect your case. A standard notary seal will be fine.

So does this mean automatic rejection and we would have to wait another 2 years??? :crying:

Not at all, sweetie!

There are 2 separate requirements:

-currently have income or income+assets at/above the 125% Poverty Guideline

-submit your last three tax returns

There is NO requirement that all 3 of those returns be at/above PG. If asked, provide an explanation of your lax year. Provide evidence of your current income and its stability (if applicable).

There is an ongoing argument about 'notarized' tax returns. Copies of your tax transcripts from the IRS are generally accepted as the genuine article---remember that there is a lot of old language left in old forms and instructions.

No, that's not what it means. It means what it says, "I'm not sure ...."

There is only 1 person who can answer your question - the consular officer who will process your wife's visa applicaton and review the material that your wife and you submit in conjunction with the application.
