Called NVC Regarding CR1...This is what they said..

hey Guys,

So i am a US Citizen applying for my wife she resides in Karachi, Pakistan.

We got married back in Jan 09, ok so i applied for k3 and 1-130 in FEB 09

Everything is going smooth until i received a letter from NVC regarding my I-130 Submittal. The letter was for AOS (Affidavitt of support).

She told me if i sent in everything for AOS and keep the process going for cr1 and if i get my K3 visa and then NVC sends in for a interview for my CR1. My wife has to travel back to Pakistan for an interview.

Is this tru?

What do you guys think i should? Should i pay the fees for DS-3032 and keep Cr1 going along or should i send in a letter saying that i will do AOS (adj of status) and then follow k3?

Please advise....

really it depends on many factors

for instant : AOS means ALOT OF MONEY and alot of waiting ..beside alot of paper work ( work permission..travel permisisons .etc .etc ..rather than dealing with USCIS for long time till approved ...and money cost as i said is mUCH HIGHER ..as a start u will pay 1010 $ for I-485 (AOS ) ..but the good is she wnt need to get back yes ..

CR-1 if u will go a long wz it ...thts much less in paperwork ..much less in money ..work at once ...bla bla ..but she will need to get back for interview at consulate ...

up to u to decide considering these factors ..

Keep the CR-1 moving through the system, this will save you the TIME and EXPENSE of adjustment form a K-3.

Many simply contact consulate or DOS and get K-3 interview rescheduled so that the I-130 can catch up to the K-3, CR-1 tends to take a few weeks longer to process.

Since USCIS has been approving both I-130 and I-129F on the same day in K-3 cases, this has essentially eliminated the reason that K-3 was developed (Entry to the USA and waiting for I-130 approval)

Follow the shortcuts and you more than likely can get I-130 to the consulate before K-3 interview.

For the most part CR-1 tends to take a bit longer than K-3 to get if you prepare for NVC when they request I-864 fee, and Visa fee, as well as documents requested by NVC. In many cases the CR-1 petition reaches the consulate just before K-3 interview, which causes K-3 to get dropped and the interview becomes a CR-1 visa interview.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

Adjustment Of Status: $1010 I-485

($1496)

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

That is one that a K-3 holder does not have a problem with, K-3 is a multi-entry visa. However, if the K-3 wanted to travel to Canada, Mexico, or the Caribbean, they WILL need a Visa for those countries, but in the case of a person with CR-1 or IR-1 IMMIGRANT visa, they could visit those countries after they entered the USA on their IMMIGRANT visa, the INSTANT GREEN-CARD (I-551 stamp in passport) will allow travel to those countries. If your wife comes here with K-3, she will not have to go back to Pakistan for CR1 interview. But in that case, you will need to file I-485 here in the US and wait for approval and it will take some time. Why don't you just go for CR1. It's less stressful and less expensive!!! Good luck!!!

now if i want o go through the CR1 Route what should i do? should i just send in the affidavit of support and mail everything back they require...how will i cancel k3 visa? Do i tell the embassy when the letter comes for interview for K3 that i have chosen the CR1 route instead of k3?

Just ignore the K-3 when the package comes from the Embassy, unless you think you can get the K-3 appointment changed to an IR-1/CR-1 appointment (I think that really depends on timing). We just ignored the K-3 package, paid the AOS and IV fees on line and we are now just waiting for the IV appointment to be scheduled. I estimate getting the IV is going to take about 6 - 8 weeks longer that the K-3, but the savings are significant and Ivonne will be able to look for work right away since she already has an SSN from working in the US in 98-99 as part of an exchange program.
