Another Denied from Nigeria K1

Hello VJer's

It is with great disappointment that our case was Denied. Reason of question was age diffence of 6yrs and use of SO name on a document. Name was never legally changed but was used. It was stated that I had no right to use a name not being his wife.

This is only a Delay I will be going to live in Nigeria, marry and stay until the approval is complete. Don’t know what will be the better choice of filing K3 or CR1. However what I do know is that I will not allow self opinions to stop our being together. I Love Francis with my whole heart and will continue my journey of becoming his wife. It has been 3yrs for us in this relationship and it has been very trying awaiting the results of others to determine our future.

I would like to think all that have been of support to Frank and I during this journey, I pray for each you much success.

I am very support to hear about all this, but I commend you for being so determined in the midst of your complications. Stay strong, and keep at it, things have a way of working out :thumbs:

Jan.04/04 Received NOA1

Feb.23/06 Sent I-129F

March06/06 USCIS Website States: "Approval Notice Sent."

March15/07 Approval notice arrives in snail mail

March 18/07 NOA1 for I-129F

April 10/07 DS-3032+ AOS fee arrive

April 17/07 Sent back DS-3032 + AOS fee via overnight delivery

May 05/07 AOS arrives in mail

May 07/07 IV bill arrives in mail

May 08/08 Sent back IV bill

May 21 NVC generates DS-230

June 4/07 Mailed DS-230 via overnight delivery.

June 7/07 DS-230 entered into the system

June 18/07 Case Complete!

July 25/07 Medical

Dec.6/07 INTERVIEW..... APPROVED!!!! (After being kept awake all night in dirty clothes standing outside my hotel because Air Canada lost my luggage and my hotel started on fire. Meh, sleep is highly over-rated anyways.)

That is bull... The lagos consulate has been denying alot here lately.... What is a age difference of 6 years? Nothing! There has to be something else going on as to why they are denying so much here lately. Did you put your name on a legal document of some sort that pertained to your case? If not, what does that have to do with the bonafides of the relationship. I wish that embassy would get it straight. They are there to check the bonafides of the relationship- that's it- any personal opinions should be left at the door in the mornings when they come in. This is why I HATE, HATE, HATE that just some random person (trained or not) has a say so over such an important part of our lives. How can you be trained to detect the affairs of the heart over people you dont even know and just met one of them that day of the interview that only last maybe 5 minutes! Something needs to be done about this embassy. It's getting ridiculous. Sorry about the rambling folks- but just.... EEEWWWWW!!!!!!

Did they actually say that you were denied because of your age difference?

I think that your mistake was using your SO's last name as your last name. It indicates that you are married (unless it is your maiden name) and so the K1 visa is the wrong visa for you.

If the CO even doubts your eligibility for the visa it is grounds to have it denied. Sounds harsh but its the truth.

I wish you luck in whatever you decide to do.

are you saying you used your FIANCE'S last name? because if you did then they do have a valid reason to deny you because it's misrepresentation.

usually, you are only allowed to use your SO's name is when you are married and you have that name legally changed. you can't just use any name you want at any given time.....

I would agree if I had done this legally, this happens all the time in US. It really dont matter at this point they will not determine my destiny. If it was not for the name it was the age as they stated. My life shall go on, and with Francis in it. :thumbs:

if you done this legally then your SO is not your fiance, it would be your husband (Spouse),and for the K-1 there would be no way to actually having your fiance's last name legally anyway, also this doesn't happen all the Time in the US. There is a difference between fiance and spouse... you should read the guides and study more carefully before moving forward...

if you done this legally then your SO is not your fiance, it would be your husband (Spouse),and for the K-1 there would be no way to actually having your fiance's last name legally anyway, also this doesn't happen all the Time in the US. There is a difference between fiance and spouse... you should read the guides and study more carefully before moving forward...

I agree with you! Why should another human that we don't know have a say over our lives..I would think their only input should be to make sure we're not importing a terrorist and that's it!! NOT if my relationship is legit. There's no scrutiny over American to American relationships.

~ 4/22/09 - sent I-129F form off to VSC

~ 11/23/09 – Interview Scheduled 11/23/2009

~ 12/09/09 – Picked up visa at MoBay DHL ofc-EXTREMELY late processing

~ 12/13/09 – Arrived at Philadelphia airport

~ 2/14/10 – WEDDING DAY FINALLY

AOS Timeline

~ 2/26/10 – mailed AOS/EAD/AP via USPS confirmed delivery

~ 2/28/10 – delivery confirmed 6:57 am

~ 3/10/10 – rec'd email acceptance confirmation from USCIS

~ 3/16/10 – rec'd NOA1's via mail for I-485, AP and EAD

~ 3/19/10 – Biometrics appt - 3/31/10 11 am

~ 3/24/10 – Walk-in Biometrics appt - 2:00 pm

~ 4/07/10 – Case transferred to National Benefits Center

~ 4/09/10 – Case transferred to CSC for processing

~ 5/01/10 – EAD card ordered rec'd notice via email

~ 5/07/10 – AP rec'd in mail...no notice at all!

~ 5/24/10 – EAP rec'd in mail

~ 6/02/10 – AOS card ordered rec'd notice via email

I agree with you! Why should another human that we don't know have a say over our lives..I would think their only input should be to make sure we're not importing a terrorist and that's it!! NOT if my relationship is legit. There's no scrutiny over American to American relationships.

Nigeria is a high fraud country, so they are not wrong by trying to validate a relationship... also the OP used her fiance's last name as being hers, she has no right using it, it's misrepresentation. if she filled out the forms correctly and brought enough evidence proving the relationship is real maybe she had a chance. :whistle: again the OP needs to read and learn more about the process....

I have to agree with this answer. When you are dealing with the government, you must cross all t's, and dot all i's. I'm so sorry, try it again, it will go through next time :blush:

I'm so very sorry to hear the news. We are all in this together, going through a very difficult separation and legal process. We all want to be with the one we love and desire to spend the rest of our lives with. You seem like a very strong woman in God, and I know that if you continue to keep God first, you and your husband to be will overcome this.

Again, I am hurting with you over this news. The waiting is excruciating and we've invested a lot in this process. I am praying for you and my heart is with you at this time.

Sept. 04, 2008 : I-130 Sent to Vermont SC - filed for spouse based on greencard

Oct. 24, 2008 : NOA 1 Received from VSC

April. 30, 2009 : Become US citizen, called USCIS to upgrade I-130 from F2A to IR-1 category

April. 30, 2009 : send a letter with copy of certificate of naturalization to upgrade the petition.

April. 30, 2009 : Status is upgraded to CR-1/IR-1 category and case is pending.

Sept 30, 2009 : NOA2 - approval notice sent Thanx to the God almighty

NVC Journey

Oct 4, 2009 : Case Number Assigned - Received this by speaking to a live operator.

Oct 16, 2009:AOS and IV Fee bills generated and rec'd Invoice id number via e-mail

Oct 20, 2009 :AOS and IV Fee bills status - Paid (online)

RFE I lost at least two weeks

Nov 15,2009 :AOS and DS-230 package sent to NVC

Dec 08,2009 :case completed at NVC (checked through AVR) Merci Jesus
