Went to the social security office today and they said they wouldn't approve it because Sam doesn't have an EAD yet. I even brought the policy that states otherwise and they said they couldn't complete the application in the system without it and that the policy only applies to other things, yadda yadda. I dunno what to do. =( Can we apply for it later after we get the we get married in two days and file for an EAD? I dunno how long that would take to get! I need advice, please help. =( I was relying on this so we could file with additional evidence on our AOS.

Can I add him to my bank account or bills without one? I don't think so. :(

Do not leave until you speak to someone trained.

For once I agree with something you said. Start yelling for a manager and tell him or her to read POMS section RM 00203.500 C1 From your time line he arrived on the 14th of April, so he still has plenty of eligibility time left as a K-1 to be assigned an SSN.

Boy ,am tossed,was hoping to apply for SSN after marriage,now 1-94 or whatever has expired and i really want to start taking driving classes.What can i do???

A marriage certificate is not enough as i am still getting documents for AOS?

If your K-1 status has expired, you need either an EAD card or I-551 stamp or card to be assigned a work authorized SSN.

You need 4 things in order to apply for a SSN card.

#1 your passport (Needed unless you have your birth certificate)

#2 your K1 visa (never needed)

#3 your UNEXPIRED I-94 showing more than 10 days before it does expire. (Need it if applying as a K-1)

#4 your marriage cert. (Only if you want the married name on the SSN record)

Answer

The K-1 symbol indicates you are the fiancé of a U.S. citizen. As such, you are eligible for a Social Security number and for employment. To apply for a Social Security number:

• Complete an Application For A Social Security Card (Form SS-5); and

• Show us documents proving:

o Immigration status;

o Work eligibility;

o Age; and

o Identity.

You need 4 things in order to apply for a SSN card.

#1 your passport

#2 your K1 visa

#3 your UNEXPIRED I-94 showing more than 10 days before it does expire.

#4 your marriage cert.

This is all you need!!

Also make sure to check the box that says you are a legal alien allowed to work. For getting a SSN card your K1 authorizes you to work. At least until your I-94 expires... I think. Anyway, it does allow you to check that box.

Not anymore, Since last month form I-9 used by employers to record confirming work authorization specifically indicates Photo ID EAD card is needed for non resident aliens, or green-card is needed for resident aliens.

Again SSA is NOT the department that authorizes work, DHS is. And DHS form I-9 specifies that a Photo ID EAD or Green-card is required in-order to work.

DHS has instructed SSA to treat K-1 as work authorized, so that the K-1 can get a SSN for the express purpose of getting a marriage license. There is another federal law on the books that indicates that in order to apply for a "License" the applicant needs to have a SSN, this was for a law dealing dead-beat dads, and had to do mostly with driver's licenses, but some states deam this has to do with ALL licenses even Marriage Licenses.

DHS has closed the K-1 "Work" loop-hole and form I-9 has been corrected to address this. It use to be that a K-1 with an EAD stamp allowed work for at least the first 90 days allowed by the I-94 card, this is no longer the case.

I'm going again today to try again and hopefully that lady won't be there! This time I'll select "legal alien not allowed to work" on the form so there should be no question about an EAD in my opnion. Will also be bringing the policy again and will ask to speak to the supervisor if they are confused again. I'm trying to find the verbage for the stamp right now. Don't they stamp the ssc with something about working? I want to explain to them that that is the type of card I need lol.

Sorry to jump on this thread but I have a question about filling out the SSN application form. I'm going down to see them tomorrow so need quick answers. What do I answer for question 3 about citizenship? Do I say I'm a legal alien NOT allowed to work, legal alien allowed to work or Other...

I'm also here on a K1 visa. My I-94 is still in good date as I only arrived on 7th May. I'm getting married on June 7th therefore have no marriage certificate.

Any help appreciated, thanks, JoJo X

Don't bother, they will printout a computer generated application for you to review and sign if everything is corrected. If filing based on K-1 status and using your I-94 as evidence of employment authorization you need to answer "Legal Alien Allowed to Work."

Wrong The Service Rep at the counter can ask for an EAD card and that's when you start yelling for a manager.
