Hi,

We are doing DCF in Israel. I've already filed the petition, received confirmation, and sent them the checklist for what they wanted. Right now we're just waiting for a notification for an interview and medical exam. I don't know how long that will take. So far we've been waiting a month, and still have not received anything.

Anyways, would we be able to apply for a work visa while we are waiting for the whole process to go through? I know that he has to be in Israel for the interview itself, so I'm wondering if it would work out or not. He has a tourist visa. He may have a possible job offer that we don't want him to miss out, that's why I ask. They would want him there sooner, and may not wait the 3-6 months (or however long it will take).

Any advice would be appreciated.

Patience, DCF is the Fastest process, the resulting visa will be CR-1 and is WORK Authorized.

An employer willing to sponsor a work visa will be needed, and that employer needs to file I-129 to USCIS in the USA, the process will be MUCH, MUCH longer that the DCF process that you are doing.

With the economy the way it is, US employers are not sponsoring visas to foreigners that easily right now anyway. Your best, and safest best, would be to wait for DCF - much quicker too!

If you are doing DCF; that means you BOTH have to reside in Israel. If you do not, you are not eligible for DCF processing and will go the regular NVC way.

I thought that if a person was waiting for the process, they would be able to try and get a work permit in the meantime. Normally it wouldn't matter, but he may have a very nice job offer, so that's why we wanted to see if it was possible.

You are thinking of a person already in the USA on a K-Visa adjusting status, they can apply for a work permit (EAD) that they can use to work while waiting for Adjustment of Status to complete.

DFS is the fastest visa process. Our K-1 took nearly a year to process from filing I-129F to getting the visa.
