Background: AOS for spouse living in US with F-1 student visa.

Question 1:

The VisaJourney AOS guide includes a section for how to put together the I-485 package. This package apparently should include other forms like the I-765 and I-864, etc. Are we supposed to package the documentation needed by these other forms (765, 864, etc) with those forms themselves (isolated from the I-485 supporting documentation), OR do we include it along with the documentation for the I-485? We're trying to figure out if, because the I-485 and the I-765 both ask for some of the same documentation (I-94, 2 passport photos, full copy of passport), do we need to include these things twice, once for the 485 and once for the 765, or do include each piece of documentation once in the I-485 package?

Question 2:

The USCIS instructions for the I-765 says the fee is waived under a list of different filing categories. I was expecting to see ( c )( 9 ) on there based on things I have heard elsewhere, but I don't see it on that list. Is the fee for the I-765 waived for a spouse already living here in the US (via F-1 student visa) and filing for AOS?

Question 3:

We have a list of documentation per form from somewhere else on the internet, and on their list it says to include a copy of I-20 and a copy of the F1 visa with the I-765 (employment auth app). We didn't see these mentioned in the I-765 USCIS instructions, so can anyone confirm whether or not we need to include these with the I-765?

Question 4:

At the assembly tips for the I-485 page, it says "Any application or petition for an individual currently in F-1 status needs to include evidence the student has been maintaining status..." My spouse is here on F-1 student status and we are wondering what sort of evidence this is referring to? Is this the I-20, or something else?

Question 5:

Is there a place to look which shows more detail about the assembly and additional documentation for the I-864 and I-765 like there is for the I-485 and I-130?

I know that's a lot of questions.... so really, a huge thank you to anyone that has patience to answer.

Consider that the I-485 is an application...The I-765 is an application... The I-130 is a petition. You need to attach all required evidence to support the application/petition. The application/petition package must be complete and to be able to stand alone.

The I-864 is neither an application or a petition. It is required evidence to support an application. Simply put it where it belongs

I-765 filing fee: Please look to Page 8 of the instructions. Look for the NOTE regarding the I-485

1. applications I-765 and I-864 goes with I-485, do not isolate. If 2 seperate applications ask for the same documents then send two seperate documents. Even tho you are sending them togehter they may be forwarde dto different places, so the same document maybe ask for 3 differents times. visit this link and follow the instructions. http://www.visajourney.com/forums/index.ph...page=i130guide2

4. Proof of maintaining status on a F1 visa would be I-20 signed up to the present day by the school.

Got engaged to my USC girlfriend Dec 2008

DEC 29th 2009 Married

JAN 27th 2010 Medical completed Jan 27th

FEB 17th 2010 AOS + I-130 package sent

FEB 25th Got emails with all receipt # ( but not able to check on USCIS site)

FEB 28th Online status check available

MAR 1st Received Hard Copy of NOA's in the mail

MAR 8th Received Biometrics appointment in mail: for Mar 18th (however no updates on site or email notifications)

MAR 9th Biometrics complete via walk-in (All docs touched on USCIS site)

MAR 26th Received interview appointment (For May 6th)

APR 23rd Touched on I-130 and I-485

APR 26th Touched on all docs, EAD card production ordered

MAY 1st Advance patrol in mail

MAY 6th Interview (Request for additional information)

MAY 6th EAD in mail

June 1st (RFE mailed in)

June 28th Notice of approval on USCIS website

July 3th GREEN CARD INT HE MAIL!!!
