Timeline

My USC husband is a physician, and is employed by his own holding company. So his paychecks are cut by himself, and his employer is himself. I am wondering what to submit with the 864 as evidence in addition to tax returns. A letter from his employer or his paychecks aren't very convincing. He has federal tax returns that show well over the poverty limit, so I'm wondering if I should just send those in instead.

Also, I am wondering if the I864 also requires supporting documentation like a copy of my passport or birthcertificate. I will be sending those docs in with the concurrently filed I-485, but I am wondering if the 864 packet should have its own copies.

Any help is much appreciated!

That is exactly what your suppose to send.

I recommend calling the IRS and have them fax over your 3 most recent tax years to you, takes 20 mins or so.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

10/9/10 - Package sent to Vermont

10/13/10 - NOA1 date, received 10/18

Thanks for the input. I had a feeling that I had to send them in, but it doesn't say that anywhere that I can see in the ten pages of instructions for the I-864

A tax return is NOT compleate unless supporting evidence is attached, anyone can download and fill out a form 1040 with numbers that look favorable.

Transcripts are a good alternative, however 2008 transcripts tend to not be available until June or July.

My joint sponsor was self-employed. We only sent his tax returns. The lawyer asked for Company Financial statments, Profit/Loss, but he didn't had that.

I see your point, but that's all we sent and no RFE's/questions asked. If I were the OP, I would just send this for now and obtain the transcript when available to take to the interview/in case of an RFE.

I think YuandDan meant you needed W-2's/1099's for the corresponding 1040's (which I think you meant by "supporting documents")
