Timeline

My Fiancee arrived in USA Feb 20. 2009. Our marriage date is May 08, 2009

We had a disagreement in mid April at which time she had bitten me and the incident was witnessed and reported to the police by a bystander.

The police arrived and arrested her. I signed a waiver to press charges on her, I DO NOT want her charged... it is a simple misunderstanding... I tried to get them to release her to me and they refused. I bailed her out the following day. I went to the police Dept and asked that NO charges be filed on her. They said they filled a report because "THE LAW MANDATES IT" @%!$^&@ and it will be turned into the DA's office. I have asked and completed requesting documents to have the case dropped, or dismissed. We will not hear from the DA's office for a few more weeks but the K-1 VISA will expire in 16 days.

After we marry in 2 days and file the AOS I-485 "HOW WILL THIS AFFECT THE APPROVAL" when line 1b: on page 3 at Section 3 at top of the page ask "Have you ever, in or outside the United States: b.) been arrested......" yes or no?

Please advise if you can...

Your interview took 205 days from your I-129F filing date.

An arrest is an arrest, so this needs to be checked "yes".

More than likely this will require evidence of the arrest, and that the charges were dropped, may get an RFE for this or be requested to bring this to an AOS interview.

An arrest is an arrest, so this needs to be checked "yes".

Thanks... Do you think the AOS could be denied? What do you think the % of problem it may cause?

Well, as long as you can show that it was handled, "no charge", then it probably would not cause an issue.

However, you better have plenty of evidence for the interview that she is lover, not a biter...

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

They may be required to reprt it, but I doubt the DA will prosecute in the absence of a "victim". There will be no "conviction". You must report the arrest and as Yu and Dan suggests will probably have to turn over the documents regarding the case. I doubt it will cause the AOS to be denied and you can use the bite marks as proof of a valid marriage. :)
