Hi all,

I'm about to file I-751 for removal of conditions and have a question about the 'list all children' in Part 5.

My wife (who is the US citizen) and I had our first child during the two year conditional period. Should I list the child in seciton 5 and what should I put for the childs immigration status?

The I-751 Instructions talk only of children adjusting status with the petition, however, conventional wisdom, common practice, and the poor wording on the I-751 in section 5 itself stating 'list all' children means most people include not just children born to the marriage, but also children who are now related via the marriage i.e. step children.

You should include your child born during the conditional period, listing the child as residing at your address, and "US Citizen" for immigration status. Put "None" in the A # box for the child.

Be sure to include the birth certificate as part of the attached proof package! Best evidence in the world. Good luck! :thumbs:

  • August 1, 2007 AOS Interview! APPROVED!! EAD APPROVED TOO...
  • August 6, 2007 EAD card and Welcome Letter received!
  • August 13, 2007 GREEN CARD received!!! 375 days since mailing the I-129F!

    Remove Conditions:

  • May 1, 2009 first day to file
  • May 9, 2009 mailed I-751 to USCIS CS
