Hi all,

I've been reading many topics, and the wonderful guides around the site, but I still feel lost as to where to start for my specific situation and I want to get this right the first time.

I'm a Canadian, currently on my 2nd TN Visa through to August 2012.

I am engaged to a US Citizen and our wedding date is September 19th this year.

Where do I start? Do I have to fill in I-130, I-765, I-485, G-325a? Or is there only certain ones of those that I have to send?

I know this has probably been answered 50000 times on here already, but everyone's situation is a bit different. I appreciate any help on getting my journey started.

Where are you currently now?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You first need to marry and then file I-130+I-485+I-765+I-131+G-325As for the I-130, and another G-325A for the I-485.

OR Better yet, since you are from Canada.

Simply marry and file JUST the I-130 for a CR-1 spousal visa, your current TN Visa is valid until 2012, and you should have your spousal visa interview in Montreal before then. This will save you at least $800 or more.

If you are confident that your Employment will not end before 2012 ( I don't know anyone that is that confident in the current economy) You can apply for the CR1 and wait for the embassy interview. But if you file the 130, 485, 765, 131 etc, you could switch to AOS pending. TN is not specifically dual intent although lots of people get AOS through employment or family that way.

If you pay the money for AOS, get the EAD and AP, you will be safe to travel about 3 months after filing (approx), can work for anyone, in case you lose your job, plus, likely you will get your CR6 greencard faster than you would ever get the CR1, and would be able to apply for Naturalization sooner (due to a faster greencard) if that is you ultimate goal.

Just my two cents, from someone who had 6 TN's and 2 H1B's before Marriage Based AOS.
