Immigrant fiance in Spain/remain or return to Peru?

Timeline

We are planning to file in the next couple of months once we get all of our documents in order (my next visit to Spain is in June). My soon-to-be fiance (I told him he must officially properly propose in person, even though he already knows the answer) is Peruvian, with a Peruvian Passport, living in Spain. He is legally allowed to live and work in Spain, but is still a Peruvian citizen. He is willing to move back to Peru if that would make our application process easier (and he wants to spend time with his elderly grandmother - as remaining in Spain would leave him unable to travel for several months). I am not certain if that would make it easier (he would be living in the country he is a citizen of), or more difficult (if they would want to know why he moved back to Peru right before filing). I am looking if anyone has been in either situation and what challenges they had. I would like to hear from people who applied from a country they were not a citizen of, and if there is anyone out there that returned to their home country right before filing for the fiance visa. We want to do whatever would make the application the easiest. Also, if there would not be much difference, because they have to check with both governments regardless, please let me know that too.

Your fiancé does not have to move back to his country of citizenship - The process can take place in the country he is a legal resident of (Spain). There is no real advantage for the process to take place in Peru. (The only disadvantages I can see might be in obtaining documents that may be required - things like birth certificate and the like, or translating documents etc (although I presume Spanish is spoken in both mentioned countries)- but that's not impossible to handle from abroad.)

If it were me - I certainly would not move back just for this reason. :thumbs:

He will need to have a poilce report from each country where he has lived. So regardless he should get that while he is in Spain.

He can apply from Spain or Peru. If he wants to go and spend time with his grandmother doesn't that make the choice much easier?

We were just in Peru in January for his sister's wedding. He stayed in Peru for a month to spend time with his family (especially his grandmother). We have been talking of getting married and what would be the best route (decided on the fiance visa, and marry here). We are concerned about several things, so we are trying to decide what country to apply from. In Spain, there is more work, which will help with all of the costs associated, and he could possibly visit Peru soon, and definitely visit Peru once he is here and his travel restrictions have been lifted. If he returns to Peru, it is likely that he would not have much work (if any) throughout the process. This is a concern if it takes more than the 6ish months we anticipate. We are also worried about obtaining the police records for his years in Peru if he does not visit Peru in the near future. I assume he is not the first person to apply from a 3rd country. I have told him the decision is up to him, that I would file once he decides what to do and (possibly) move back to Peru. Can the Peruvian Consulate in Madrid help him obtain the proper police records from Peru without going to Peru? Does anyone know specific advantages/disadvantages in applying from Spain versus applying from Peru?

My fiance is Colombian and we went through the fiance visa process in Spain. He was living and working legally in Barcelona. The process was easy. The people at the US Consulate in Madrid are Awesome!!! As for your fiance obtaining police certificates from Peru, he should be able to obtain them through the Peruvian Embassy in Spain. He should get that ASAP as for the Colombian Embassy in Spain takes 2 months to get them. As for getting documents translated from Spanish to English it is not necessary in Spain. Although it will be the US.

My fiances case was approved in a total of 4 months from time of filing to the day when we received his visa.

My fiance left Spain on May 5th to visit family in Colombia before coming to the US. He will arriving in the US on June 3rd.

I wish you guys the best of luck. If you have any more questions in regards to the Embassy in Madrid just let me know. I'll be more than happy to help you guys out.

Timewise it probably wont make any difference if you use embassy in Peru or spain.

I am a UK citizen but I live in Austria so I chose to use the Embassy here and had to get documents from UK and Austria, if I had chosen to use UK embassy I would still of had to get docs from both countries.
