Hi everyone. Our application was denied but it is totally fixable. How soon can we send in a new application? Do we need to wait a certain amount of time or can I gather up all new paperwork and resubmit right away??

Timeline:

10/29/07: First time we met in Bangalore

11/19/07: Realized we were in love

02/22/08: Her next trip to India

04/18/08: She left India

05/30/08: My first trip to US

06/09/08: Left for India

02/12/09: Visited her again for Valentines

05/27/09: Mailed application to Vermont Service Center

06/01/09: Received NOA1

07/09/09: Visited her again in US

09/13/09: Received NOA2

09/22/09: Beth received letter from National Visa Center saying package was received and will be forwarded to Chennai within the week

09/25/09: Received email from Chennai with all the docs and interview date of October 29, 2009.

10/29/09: Interview in Chennai. Visa APPROVED!!!

12/10/09: Arrived at DFW, 5 min at the POE & i am in, apparently the officer who interviewed got his wife to USA on K1 visa,what an irony

02/14/10: Wedding at Southfork Ranch in Dallas Texas

02/14/10: Headed for a honeymoon in Las Vegas :)

02/17/10: Back from honeymoon

02/22/10: Started thinking about AOS,EAD,AP (its too much paper work)

03/06/10: Filed the AOS,EAD,AP application

03/26/10: Received NOA for AOS,EAD,AP

04/05/10: Received NOA I-797C for AOS (Case transfered to CA CSC)

04/28/10: Received NOA I-797C for Bio-metrics appointment

05/18/10: Bio-Metrics taken at the Fort Worth ASC

05/20/10: Received my AP document :)

06/03/10: Received my EAD Card and a "Welcome Letter" stating my Permanent Resident Card will be mailed soon... :)

06/17/10: Received my Permanent Resident Card (Green Card) :)

as far as i know as long as u have the ability to correct what ever was the issue with the first one u can file it right away

What was the official reason for the denial? (And at what stage was the petition? or was it at the Visa stage?)

It was because of the dates of my divorce from my previous husband. The Vermont Service Center denied it. It never left the US.

Please tell me I can send in a new application right away. I cant appeal so I will have to just start over.

The dates? did the VSC think it was fraud in regards to the dates? or did they think you were still married when you were applying for a K1 visa?

Yes, I am most curious. This is the first denial I've heard of at this level.

It was because there is a waiting period here before you can marry again. It was still inside the waiting period when I sent in the application. I know.....stupid.......

What is the waiting period in your state? I am filing at the end of the month and my divorce was final 1-29-09 but the waiting period here is 90 days....do you think I will have a problem?

If the waiting period is 3 months & you file at the end of 4 months, I wouldn't think you'd have a problem.

If the waiting period is 3 months & you file at the end of 4 months, I wouldn't think you'd have a problem.

problem is VSC can't count!!!

i do not understand what a waiting period would have to do with it because by the time it is approved it takes more then three months so the state where it would be filed would be ok. i was divorced january 20th and i sent it in february 20th. it is now may 11th so the three months would be over so why would that be a problem?

USCIS goes by the date you filed, not the date after your file sat on some clerk's desk for 3 months collecting dust. With that being said I didn't think that a waiting period was an issue, but rather as long as both parties were completely free to marry at the time of the application (i.e. no pending divorce proceedings).

With that being said I didn't think that a waiting period was an issue, but rather as long as both parties were completely free to marry at the time of the application (i.e. no pending divorce proceedings).

Wow, that really sucks to have such a delay due to having to refile. I filed the K-1 for my fiance 3 days after I received my final divorce decree (obviously I left my ex-husband for my fiance). But I am lucky in that my state there is no waiting period for remarraige after divorce so we are eligable to marry at the time of the filing.

When I called the Dept of Immigration to talk about something else to do with the application, they went through a stream of questions. One of them had to do with how long I had been divorced, and they made a point of saying that I could not file until the 90 day waiting period was up.

I wouldn't risk it.

USCIS means that if they approved the application the day you sent it that you could marry that day. SO don't get caught by waiting times or even days it takes to be officially recorded.
