Hello everybody!

We are newly weds. I (the wife) arrived from The Netherlands on the 7th of February for a vacation, and then out of the blue we decided to get married 2 months into my stay here, so this means I'm still here. We are struggeling to get all the paper work in order.

Originally we were told by USCIS that we could submit the medical exam later. However upon further inquiring we learned that not submitting the medical exam with the other forms (G-325a, I-130, I-131, I-765 and I-864) might lead to some delays in processing (not good :blink: ). I go out of status on the 8th of may, and I've been calling every civil surgeon within a 20 mile radius, alas to no avail, nobody can see me this week.

So now we have a dillema; do I submit all the forms without the medical, or do I go out of status for a couple of days? What are the risks involved with going out of status, deportation :crying: ?? All help will be much appreciated, we are sort of having a panic attack about this.

I would submit your application now (make sure you keep a copy and send it return receipt) and wait for an RFE or a request to bring the medical to your interview. Go to the earliest appointment with a CS, complete the paperwork, ask them to make a copy and keep it until USCIS ask for it. Since you came on as a visitor and then got married, there may be additional consideration of whether or not the two of you were trying to circumvent the immigration process so I would not want to add an overstay- of even a few days- to the situation.

Our situation is very similar however we sent the papers (I-130/485/765) without the medical exam because I understood it would be requested later & they did one month after we submitted the docs.

I would send them in ASAP even if you have to do it without the exam so you don't go to long out of status. (it is my understanding that they will forgive a short overstay as long as the documents are sent in ASAP, they allow for the amount of time to gather necessary paperwork).

We received a pink RFE managed to find a Civil Surgeon who only did walk-Ins we were the only people there both days (first day for exam, vaccinations & TB test & the 2nd to have the TB test read and pick up the docs for Immigration)

Also as stated above wait for the RFE & send when requested by certified mail! You can never have to much documentation! My current folder just split so now it's time to upgrade to a 3 ring binder so be prepared LOL

Thank you so much for the responses, it's nice to know that there are people going through the same process. Will not submitting the medical at the same time lead to a delay in me getting my EAD? Thank you!

OMG I had same panic attack and now i am release saw this topic.

my status will expire really soon and wasnt ready to have medical.

I am almost ready to file now then!

Hi,

I just recently sent in my package, 30th of April, and did not include the I-693 as it will not be ready to send until the 13th of this month and I am due to go out of status on the 18th. I decided I would much prefer to have the processing take a little longer than normal rather than risk any kind of overstay.

I have to collect my blood test results on the 11th and straight from there I am going for my first appointment with the Civil Surgeon and the follow up for the TB test is on the 13th.

From what I understand it is no big deal that you don't send it in as they will just send an RFE.

Let us know when you do decide to file and how it goes!

There is a May AOS thread somewhere around that I started so if you want you can join that and we can share our experiences just like the April Aos filers have done.

07/23/09 - I called to have a service request put in

07/24/09 - I-765 Touched (FINALLY)

07/25/09 - I-765 CARD PRODUCTION ORDERED!!!!!!!! (About time!)

08/03/09 - EAD card came in the mail WOOHOO!!!

08/07/09 - Interview letter arrived

09/02/09 - Interview Date

09/07/09 - I think this is the day I received my Green Card.. Can't quite remember anymore.

Removal Of Conditions

08/03/11 - WOW it's already been TWO years! Sent ROC package to VSC.

08/05/11 - NOA1 date which arrived 8/10/2011

09/02/11 - Bio Appointment the notice was dated 8/12/11
