My wife is currently in the US on a K-3 visa. She has applied for AOS and an EAD. In fact, she had her interview 2 weeks ago and we are hoping that the process concludes quickly. My question is regarding an AP, does she need this form to travel abroad? I keep getting conflicting info. I called the USCIS and they said I needed this document, so did my lawyer. However, the first page of the I-131 instructions as well as this site indicate that she does NOT need an AP to travel abroad. Please help sort out the confusion!

By the way, she's not planning on travelling but should the need arise I want her to have the option to go home. Thanks in advance for your help!

you need AP to travel outside of the USA while your case is still in process, I'm not sure how this works once you're approved though. It is free to apply for AP if you have already applied for AOS so it can't hurt to do it just in case.

Interview passed 6/30/09

Filed for ROC 6/21/11

Once you have Green Card in hand, the AP is no longer needed.
