Good day to everyone!!! I just opened my mail today from SSA office about my SSN no. and its so frustrating that they denied to give me a number.It says in their letter that " they can`t give my Social Security Number because my legal immigration status/documents expire before an SSN card can be issued to you."

I applied SSN a month ago before my visa expires and I submitted all my documents and how come they did n`t review my status ? and currently I am processing for my change of status now. I am just venting because of this, as if it`s unfair some got their SSN after few days....!

What I am going to do now? just wait until I process my AOS? or visit again to SSA office and asks them to review my case?

For those out there who will be planning to get their SSN, don`t wait a month before your visa expires, I guess its better if you can apply early as possible. So you won`t experience this.

Yup - most folks have greater success when getting their SS card/number shortly (2-weeks or so) after entry to the US - technically you must have at least 14 days remaining on the I-94 (not the visa) - and most have greater success in doing so before they get married.

OP - You'll need to wait until you get your EAD/PR-Green Card at this point, there is nothing to 'review'.

The visa was VOIDED the moment you used it to enter the USA, the Expiration date on the visa has nothing to do with when you need to apply for SSN or adjust status, that date is only the last date that you must use the visa by to enter the USA nothing else.

K-1 can only apply for SSN within 76 days of entery to the USA, SSA will not issue one if you have less than 10 days left on the I-94 card.

K-1 is allowed to get SSN for one reason only, that is to be able to apply for a marriage license, in some states a SSN is required befor you can get the marriage license.

In your case you will need to wait to apply for SSN when you have the other reason for getting SSN, (Employment Authorization) you need to have EAD OR Green-card to show that you are work authorized, at that time SSA will issue SSN.

Hello everyone,

Just for the record we live in New Jersey(Union Townpship) and we could get married without my husband's SSN, they only asked for his translated BC, passport, and a notarized letter from me stating since when he is living in the town and in which address. The clerk was very nice and made the process smooth. Then he applied for the SSN 11 days after arrival and he will get it in about two weeks. See my timeline.

No, the OP need only wait for their EAD, not for their green card. They should have it +/-90 days after their I-765 was accepted whereas their green card will likely take several months longer.

To the OP: When you get your EAD, wait 1-2 weeks from receipt before you visit the SSA again. They are required to check your details against a USCIS database to verify your eligibility for an SSN and it can take a couple of weeks from issue of the EAD for this database to be updated. If you go before your status in the database is updated, you'll get stuck in extra processing, which will delay issue of your SSN even more.

I applied SSN within 1 week after my arrival here in the U.S. I just showed them my passport with my I-94 and the staff who assisted me made a copy of it and returned my passport and gave me application form to filled up then after that she gave me confirmation letter that I applied ssn on that day and it took 2weeks before I received my SSN on the mail.

Hello, thanks for those who replied in my posts. They send me a snail mail last May 1, 2009 stating that they can`t issue me a number, prior to the letter I received I call their office exactly one month of my application and personnel whom I talked to told me that my application were still on process and they still have to verify my status in Department of Homeland and Security. When they send me a snail mail my visa was not expired yet, just about to expire few days after I received that mail. That`s their reason why they can`t issue me a number .

You can visit your local SSA office too for some inquiry or you may call them for follow up. Hope it helps !
