Hello all,

When sending in the I-130 petition, i read it as saying if you dsubmit tax transcripts from IRS then you do not nedd to send in 1040 and w2 forms. However, i read on a few guides saying send in tax transripts and w2 and some even added 1040 to the list.

What needs to be submitted witht he petition, just the irs tax transcripts? I have the last three years of tax transscripts.

Also, what about the current year to date pay stubs, when do you send those in?

tax transcripts have all you will need.

That is all I used.

Read the instructions, they tell you either transcripts, or 1040/w-2/1099s.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

the instructions about this are clear :

please send W2,1040 AND/OR tax transcripts

so u can simply send the tax transcripts wzout the need to send any W2 , 1040 forms

or the opposite

sending ALL documents is good to make things even more clear ..it wnt hurt ..

i sent latest 1040 plus 3 years transcripts and last 4 years W2's.

also dont delay getting transcripts....i tried using the forms....(forgot numbers now) but was forced to goto a local IRS office to retrieve them.

although that was not the 130 was it?

i thought that was the 864 that needed those

Wait, if your just sending I-130 to USCIS and just starting immigration process, why are you now sending tax info.??? All tax info is for the NVC stage after you are approved by USCIS. Same thing with pay stubs, NVC stage.

Also, please do a time line. :time::time:

Correct, these are required for the I-864, NOT the I-130.

We sent only the previous 3 years transcripts and were fine!

Doh! You might get an RFE for the W-2's that do not have the corresponding 1040's. Depending on who checks your files. But since you have the transcripts, they may overlook that.

For transcripts, you can call the IRS and they can fax them over to you in 20 mins or so. I did!

i sent the transcripts but they refused to respond to my faxed request.

apparently they could not verifiy who i was . ( i had moved) so i had to goto a local office and get transcripts in person.

i hope they dont rfe for 1040's....... :P

Well - let us know what happens - would be interesting to see what they do.

(the practical person in me says they wont bother, since you have transcripts :innocent: , the jerk in me says "RFE time" :devil: )

But I think they will side with the practical :thumbs:
