We are wanting to know how my wives prior charge (2001 canadian charge of theft under 5000) will affect our immigration process. If she would be inadmissable and if we should file a waiver. Would you recommend not calling and asking, or would they be able to tell us anything? and if we should call, would the local field office be best?

USCIS does not make the initial determination but the consulate does... So calling or visiting the USCIS may not provide the information you seek.

well shes already here and we are married. we are filing our i-485 and worried it will affect that, and her being able to adjust status to permanent resident.

a finding of inadmissibility affect entry into the country and would need to have occured BEFORE she entered... since she was admitted, then I cannot imagine it will be any further issue.
